Permanente de Licita\u00e7\u00e3o\u00a0 Beltrano da Silva (doc.03).<\/p>\n<p><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/strong>Conforme pode verificar, para compra de m\u00f3veis e equipamentos para escrit\u00f3rio e informando que os demais documentos e a planilha encontravam-se \u00e0 disposi\u00e7\u00e3o na Comiss\u00e3o Permanente de Licita\u00e7\u00e3o, aonde me dirigi e ap\u00f3s muita dificuldade consegui a planilha o Edital completo com a planilha (doc.4).<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Para espanto de todos, os itens a serem comprados indicavam ser obrigatoriamente da marca BELLO, marca esta de exclusividade da f\u00e1brica que leva o mesmo nome e tem apenas um representante, amigo pessoal do Prefeito, que se orgulha de dizer aos quatro ventos que ajudou a eleg\u00ea-lo, e o valor total estimado de R$ 240.000,00 sendo que na condi\u00e7\u00e3o de pagamento anteciparia 50%\u00a0 no ato do pedido e seria realizada 72 horas depois, no caso depois de amanh\u00e3, 25 de abril .<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0Inconformado, o vereador visitou a empresa BELLO e constatou em conversa com o Sr. Farofeiro da Silva, representante da BELLO e propriet\u00e1rio da Empresa VENDO TUDO, que o Edital s\u00f3 o beneficiaria uma vez que estava definida a marca dos m\u00f3veis e somente ele poderia participar, e mais me disse, uma m\u00e3o lava a outra. Essa carta \u00e9 marcada e \u00e9 minha.<\/p>\n<p><strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 VENDE TUDO \u00e9 a \u00fanica empresa local de venda de m\u00f3veis e equipamentos recentemente criada no Munic\u00edpio, o que nos faz parecer que para esse prop\u00f3sito de fraudar a licita\u00e7\u00e3o uma vez que a publicidade do Edital n\u00e3o foi ampla, apenas colocada no quadro de avisos dentro da sala da Comiss\u00e3o de Licita\u00e7\u00e3o.<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 07\/06.<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Destarte, colocar que o principio da igualdade imp\u00f5em \u00e0 Administra\u00e7\u00e3o, elaborar regras claras que assegurem aos participantes da licita\u00e7\u00e3o, <em>equival\u00eancia durante a disputa, sendo intoler\u00e1vel o DO PRINC\u00cdPIO DA PUBLICIDADE<\/strong><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 H\u00e1 de se verificar, ainda, que n\u00e3o houve publicidade, sendo esta restringida a coloca\u00e7\u00e3o num quadro de avisos dentro da sala da Comiss\u00e3o.<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 O princ\u00edpio da publicidade exige que a Administra\u00e7\u00e3o anuncie com anteced\u00eancia e pelos meios previstos na lei, al\u00e9m de outros que ampliem a sua divulga\u00e7\u00e3o, que realizar\u00e1 a licita\u00e7\u00e3o e que todos os atos a ela pertinentes sejam acess\u00edveis aos interessados.<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ferindo o princ\u00edpio da publicidade tamb\u00e9m verificamos que n\u00e3o houve nenhuma divulga\u00e7\u00e3o na radio local, nem no matutino local ou da capital, apenas no quadro de aviso dentro da sala da Comiss\u00e3o como j\u00e1 dito, que tem acesso restrito e em hor\u00e1rio irregular, portanto, n\u00e3o houve acesso a concorrentes interessados.<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 H\u00e1 de se comungar com <strong>Jess\u00e9 Torres Pereira Junior<\/strong> quando diz: <\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong><em>\u201cLicita\u00e7\u00e3o sem competi\u00e7\u00e3o \u00e9 fraude ou n\u00e3o-\u00a0 licita\u00e7\u00e3o\u201d.<\/em><\/strong><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Outro n\u00e3o foi o motivo que levou a Lei 4.717\/65 a cominar a san\u00e7\u00e3o de nulidade a ser declarada em A\u00e7\u00e3o Popular, quando o Edital for processado em condi\u00e7\u00f5es que impliquem na limita\u00e7\u00e3o das possibilidades normais de competi\u00e7\u00e3o. (Lei 4.717\/65, art. 4\u00ba, II,a,b,c).<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00c9 o que mostra a forma que foi feito o Edital, melhor dizendo, como foi fraudado o referido Edital 07\/06.<\/p>\n<p><strong>3.3.
