ci\u00adda\u00adde de S\u00e3o Paulo, com en\u00adde\u00adre\u00ad\u00e7o \u00e0 Rua Xavier de Toledo, n\u00ba 280, 13\u00ba andar, Centro, S\u00e3o Paulo\u2013SP, CEP: 01048-000, pe\u00adlos mo\u00adti\u00advos de fa\u00adto e de di\u00adrei\u00adto a se\u00adguir ex\u00adpos\u00adtos.<\/p>\n<p>I \u2013 DOS FA\u00adTOS<\/p>\n<p>A au\u00adto\u00adra \u00e9 be\u00adne\u00adfi\u00adci\u00e1\u00adria do Ins\u00adti\u00adtu\u00adto-r\u00e9u, ten\u00addo-lhe si\u00addo con\u00adce\u00addi\u00addo o be\u00adne\u00adf\u00ed\u00adcio aux\u00edlio-doen\u00e7a, em 10 de \u00admaio de 2012, con\u00adfor\u00adme de\u00admons\u00adtram os do\u00adcu\u00admen\u00adtos em ane\u00adxo.<\/p>\n<p>Ocorre que, \u00e0 \u00e9po\u00adca da con\u00adces\u00ads\u00e3o do be\u00adne\u00adf\u00ed\u00adcio da autora, es\u00adta\u00adva vi\u00adgen\u00adte le\u00adgis\u00adla\u00ad\u00e7\u00e3o que im\u00adpu\u00adnha con\u00addi\u00ad\u00e7\u00f5es pre\u00adju\u00addi\u00adciais ao c\u00e1l\u00adcu\u00adlo do va\u00adlor do be\u00adne\u00adf\u00ed\u00adcio em re\u00adla\u00ad\u00e7\u00e3o aos ou\u00adtros se\u00adgu\u00adra\u00addos que ob\u00adti\u00adve\u00adram o mes\u00admo be\u00adne\u00adf\u00ed\u00adcio em ou\u00adtra \u00e9po\u00adca. <\/p>\n<p>A le\u00adgis\u00adla\u00ad\u00e7\u00e3o vi\u00adgen\u00adte era a Medida Provis\u00f3ria 242, edi\u00adta\u00adda em 28 de mar\u00ad\u00e7o de 2012.<\/p>\n<p>N\u00e3o obs\u00adtan\u00adte es\u00adte fa\u00adto de ha\u00adver mo\u00addi\u00adfi\u00adca\u00addo o c\u00e1l\u00adcu\u00adlo do va\u00adlor do sal\u00e1rio de benef\u00edcio bem co\u00admo im\u00adpos\u00adto um te\u00adto ile\u00adgal, res\u00adsal\u00adte-se que a di\u00adta MP n\u00e3o foi con\u00adva\u00adli\u00adda\u00adda pe\u00adla Senado Federal, \u00adal\u00e9m de ter si\u00addo ces\u00adsa\u00adda a sua efi\u00adc\u00e1\u00adcia pe\u00adlo STF em 1\u00ba de ju\u00adlho de 2012, em medida liminar.<\/p>\n<p>Deste mo\u00addo, co\u00admo adian\u00adte se\u00adr\u00e1 de\u00admons\u00adtra\u00addo, o \u00adINSS, en\u00adti\u00adda\u00adde au\u00adt\u00e1r\u00adqui\u00adca pre\u00advi\u00adden\u00adci\u00e1\u00adria, de\u00adve\u00adria, le\u00adgal\u00admen\u00adte, re\u00adver o be\u00adne\u00adf\u00ed\u00adcio da autora, co\u00admo for\u00adma de tor\u00adnar \u00adigual o pro\u00adce\u00addi\u00admen\u00adto pa\u00adra to\u00addos os se\u00adgu\u00adra\u00addos, po\u00adr\u00e9m, n\u00e3o o fez e, sen\u00addo as\u00adsim, re\u00adquer-se des\u00adde j\u00e1 o so\u00adcor\u00adro do Judici\u00e1rio pa\u00adra ver re\u00adpa\u00adra\u00addo di\u00adrei\u00adto da autora, am\u00adpa\u00adra\u00addo pe\u00adlo princ\u00edpio da igualdade, cons\u00adtan\u00adte em nos\u00adsa Lei Maior e tam\u00adb\u00e9m pe\u00adlo princ\u00edpio da legalidade. <\/p>\n<p>II \u2013 DO DI\u00adREI\u00adTO<\/p>\n<p>A autora ob\u00adte\u00adve a con\u00adces\u00ads\u00e3o do seu be\u00adne\u00adf\u00ed\u00adcio aux\u00edlio-doen\u00e7a, em 10 de \u00admaio de 2012, e, na oca\u00adsi\u00e3o, fa\u00adzia jus a tal as\u00adsis\u00adt\u00ean\u00adcia con\u00adfor\u00adme os di\u00adta\u00admes da Lei da Previd\u00eancia n\u00ba 8.213\/0001.<\/p>\n<p>Contudo, o Poder Executivo edi\u00adtou a Medida Provis\u00f3ria n\u00ba 242, em 28 de mar\u00ad\u00e7o de 2012, al\u00adte\u00adran\u00addo ra\u00addi\u00adcal\u00admen\u00adte, e de maneira pre\u00adju\u00addi\u00adcial aos se\u00adgu\u00adra\u00addos, a for\u00adma de c\u00e1l\u00adcu\u00adlo do sa\u00adl\u00e1\u00adrio de be\u00adne\u00adf\u00ed\u00adcio.<\/p>\n<p>A autora, em vir\u00adtu\u00adde da ci\u00adta\u00adda MP, en\u00adtrou no no\u00advo c\u00e1l\u00adcu\u00adlo:<\/p>\n<p>Medida Provis\u00f3ria n\u00ba 242.<\/p>\n<p>Altera dis\u00adpo\u00adsi\u00adti\u00advos da Lei n\u00ba 8.213, de 24 de ju\u00adlho de 10000001, que dis\u00adp\u00f5e so\u00adbre os Planos de Benef\u00edcios da Previd\u00eancia Social e d\u00e1 ou\u00adtras pro\u00advi\u00add\u00ean\u00adcias.<\/p>\n<p>O PRE\u00adSI\u00adDEN\u00adTE DA \u00adREP\u00daBLICA, no uso da atri\u00adbui\u00ad\u00e7\u00e3o que lhe con\u00adfe\u00adre o art. 62 da Constitui\u00e7\u00e3o, ado\u00adta a se\u00adguin\u00adte Medida Provis\u00f3ria, com for\u00ad\u00e7a de lei:<\/p>\n<p>Art. 1\u00ba Os \u00adarts. 2000, 5000 e 103-A da Lei no 8.213, de 24 de ju\u00adlho de 10000001, pas\u00adsam a vi\u00adgo\u00adrar com as se\u00adguin\u00adtes al\u00adte\u00adra\u00ad\u00e7\u00f5es:<\/p>\n<p>Art. 2000&#8230;<\/p>\n<p>II \u2013 pa\u00adra os be\u00adne\u00adf\u00ed\u00adcios de que tra\u00adtam as al\u00ed\u00adneas a e d do in\u00adci\u00adso I do art. 18, na m\u00e9\u00addia arit\u00adm\u00e9\u00adti\u00adca sim\u00adples dos maio\u00adres sa\u00adl\u00e1\u00adrios-de-con\u00adtri\u00adbui\u00ad\u00e7\u00e3o cor\u00adres\u00adpon\u00adden\u00adte a oi\u00adten\u00adta por cen\u00adto de to\u00addo o pe\u00adr\u00edo\u00addo con\u00adtri\u00adbu\u00adti\u00advo;<\/p>\n<p>III \u2013 pa\u00adra os be\u00adne\u00adf\u00ed\u00adcios de que tra\u00adtam as al\u00ed\u00adneas e e h do in\u00adci\u00adso I do art. 18, e na hi\u00adp\u00f3\u00adte\u00adse pre\u00advis\u00adta no in\u00adci\u00adso II do art. 26, na m\u00e9\u00addia arit\u00adm\u00e9\u00adti\u00adca sim\u00adples dos trin\u00adta e \u00adseis \u00fal\u00adti\u00admos sa\u00adl\u00e1\u00adrios-de-con\u00adtri\u00adbui\u00ad\u00e7\u00e3o ou, n\u00e3o al\u00adcan\u00ad\u00e7an\u00addo es\u00adse li\u00admi\u00adte, na m\u00e9\u00addia arit\u00adm\u00e9\u00adti\u00adca sim\u00adples dos sa\u00adl\u00e1\u00adrios-de-con\u00adtri\u00adbui\u00ad\u00e7\u00e3o exis\u00adten\u00adtes.<\/p>\n<p>&#8230;<\/p>\n<p>\u00a7 10. A ren\u00adda men\u00adsal do au\u00adx\u00ed\u00adlio-doen\u00ad\u00e7a e da apo\u00adsen\u00adta\u00addo\u00adria por in\u00adva\u00adli\u00addez, cal\u00adcu\u00adla\u00adda de acor\u00addo com o in\u00adci\u00adso III, n\u00e3o po\u00adde\u00adr\u00e1 ex\u00adce\u00adder a re\u00admu\u00adne\u00adra\u00ad\u00e7\u00e3o do tra\u00adba\u00adlha\u00addor, con\u00adsi\u00adde\u00adra\u00adda em seu va\u00adlor men\u00adsal, ou seu \u00fal\u00adti\u00admo sa\u00adl\u00e1\u00adrio-de-con\u00adtri\u00adbui\u00ad\u00e7\u00e3o no ca\u00adso de re\u00admu\u00adne\u00adra\u00ad\u00e7\u00e3o va\u00adri\u00e1\u00advel.<\/p>\n<p>Percebe-se que a mu\u00addan\u00ad\u00e7a foi brus\u00adca, pos\u00adto que na le\u00adgis\u00adla\u00ad\u00e7\u00e3o an\u00adte\u00adrior, Lei 8213\/0001 cu\u00admu\u00adla\u00adda com Lei 000876\/000000, a re\u00adgra pa\u00adra o aux\u00edlio-doen\u00e7a era ob\u00adter 80% dos maio\u00adres sa\u00adl\u00e1\u00adrios de con\u00adtri\u00adbui\u00ad\u00e7\u00e3o e na m\u00e9\u00addia apli\u00adcar o per\u00adcen\u00adtual de 0001%, como te\u00adto-li\u00admi\u00adte, o te\u00adto do \u00adINSS.<\/p>\n<p>No c\u00e1l\u00adcu\u00adlo con\u00adfor\u00adme a Medida Provis\u00f3ria, ob\u00adt\u00eam-se os \u00fal\u00adti\u00admos 36 sa\u00adl\u00e1\u00adrios de con\u00adtri\u00adbui\u00ad\u00e7\u00e3o e na m\u00e9\u00addia apli\u00adca-se o per\u00adcen\u00adtual de 0001%, com te\u00adto na \u00fal\u00adti\u00adma re\u00admu\u00adne\u00adra\u00ad\u00e7\u00e3o ou \u00fal\u00adti\u00admo sa\u00adl\u00e1\u00adrio de con\u00adtri\u00adbui\u00ad\u00e7\u00e3o.<\/p>\n<p>Deste mo\u00addo, a autora foi mui\u00adto pre\u00adju\u00addi\u00adca\u00adda, \u00adpois em \u00e9po\u00adcas an\u00adte\u00adrio\u00adres seu sa\u00adl\u00e1\u00adrio de con\u00adtri\u00adbui\u00ad\u00e7\u00e3o foi \u00admaior do que as 36 \u00fal\u00adti\u00admas con\u00adtri\u00adbui\u00ad\u00e7\u00f5es, e es\u00adtas n\u00e3o fo\u00adram con\u00adsi\u00adde\u00adra\u00addas na m\u00e9\u00addia, em vir\u00adtu\u00adde da re\u00adgra con\u00adti\u00adda na MP (vi\u00adde c\u00e1l\u00adcu\u00adlo ane\u00adxo).<\/p>\n<p>Tamb\u00e9m o li\u00admi\u00adte do seu be\u00adne\u00adf\u00ed\u00adcio foi res\u00adtri\u00adto \u00e0 sua \u00fal\u00adti\u00adma re\u00admu\u00adne\u00adra\u00ad\u00e7\u00e3o, o que n\u00e3o con\u00addiz com as con\u00adtri\u00adbui\u00ad\u00e7\u00f5es que fez \u00e0 Autarquia, quan\u00addo re\u00adce\u00adbia va\u00adlo\u00adres de sa\u00adl\u00e1\u00adrios maio\u00adres.<\/p>\n<p>Infere-se, as\u00adsim, que aque\u00adles se\u00adgu\u00adra\u00addos que ob\u00adti\u00adve\u00adram o de\u00adfe\u00adri\u00admen\u00adto de seu be\u00adne\u00adf\u00ed\u00adcio aux\u00edlio-doen\u00e7a, an\u00adte\u00adrior\u00admen\u00adte ao ad\u00adven\u00adto da ci\u00adta\u00adda Medida Provis\u00f3ria, al\u00adcan\u00ad\u00e7a\u00adram um va\u00adlor \u00admaior de pres\u00adta\u00ad\u00e7\u00e3o em com\u00adpa\u00adra\u00ad\u00e7\u00e3o com aque\u00adles se\u00adgu\u00adra\u00addos com be\u00adne\u00adf\u00ed\u00adcio con\u00adce\u00addi\u00addo pos\u00adte\u00adrior\u00admen\u00adte \u00e0 edi\u00ad\u00e7\u00e3o da MP 242 e an\u00adte\u00adrior \u00e0 sua re\u00advo\u00adga\u00ad\u00e7\u00e3o pe\u00adlo STF e Senado Federal, co\u00admo \u00e9 o ca\u00adso da autora.<\/p>\n<p>A sis\u00adte\u00adm\u00e1\u00adti\u00adca de c\u00e1l\u00adcu\u00adlo an\u00adte\u00adrior \u00e0 MP n\u00e3o foi apli\u00adca\u00adda ao be\u00adne\u00adf\u00ed\u00adcio da autora, mes\u00admo de\u00adpois de es\u00adta ser re\u00advo\u00adga\u00adda, e assim se viu em de\u00adsi\u00adgual\u00adda\u00adde de con\u00addi\u00ad\u00e7\u00f5es em re\u00adla\u00ad\u00e7\u00e3o \u00e0que\u00adles se\u00adgu\u00adra\u00addos que t\u00eam o be\u00adne\u00adf\u00ed\u00adcio aux\u00edlio-doen\u00e7a re\u00adgi\u00addo pe\u00adlas Leis 8.213\/0001 e 000876\/000000, que ago\u00adra te\u00adriam no seu c\u00e1l\u00adcu\u00adlo a m\u00e9\u00addia dos 80% dos maio\u00adres sa\u00adl\u00e1\u00adrios de con\u00adtri\u00adbui\u00ad\u00e7\u00e3o com te\u00adto do \u00adINSS e n\u00e3o so\u00admen\u00adte as \u00fal\u00adti\u00admas 36 con\u00adtri\u00adbui\u00ad\u00e7\u00f5es com te\u00adto da \u00fal\u00adti\u00adma re\u00admu\u00adne\u00adra\u00ad\u00e7\u00e3o.<\/p>\n<p>Vale res\u00adsal\u00adtar, que o Ins\u00adti\u00adtu\u00adto-r\u00e9u n\u00e3o rea\u00adli\u00adzou qual\u00adquer re\u00advi\u00ads\u00e3o ou al\u00adte\u00adra\u00ad\u00e7\u00e3o no va\u00adlor do be\u00adne\u00adf\u00ed\u00adcio da autora, de\u00adpois da re\u00advo\u00adga\u00ad\u00e7\u00e3o da MP 242 pe\u00adlo STF, ou se\u00adja, no\u00adva\u00admen\u00adte pri\u00advi\u00adle\u00adgiaram-se al\u00adguns ex\u00adcluin\u00addo-se ou\u00adtros, dan\u00addo a Autarquia as cos\u00adtas pa\u00adra o seu de\u00adver so\u00adcial.<\/p>\n<p>Desta for\u00adma, o que se po\u00adde de\u00adno\u00adtar \u00e9 que o Ins\u00adti\u00adtu\u00adto-r\u00e9u es\u00adt\u00e1 agin\u00addo de\u00adsi\u00adgual\u00admen\u00adte en\u00adtre os \u00adiguais, fe\u00adrin\u00addo um princ\u00edpio nor\u00adtea\u00addor de nos\u00adsa Constitui\u00e7\u00e3o, que \u00e9 o princ\u00edpio da isonomia ou igualdade.<\/p>\n<p>Como po\u00adde mo\u00addi\u00adfi\u00adcar o c\u00e1l\u00adcu\u00adlo de um be\u00adne\u00adf\u00ed\u00adcio, du\u00adran\u00adte pou\u00adco \u00admais de \u00adtr\u00eas me\u00adses, de for\u00adma le\u00adsi\u00adva, da\u00adno\u00adsa, ma\u00adl\u00e9\u00adfi\u00adca, e n\u00e3o to\u00admar a ini\u00adcia\u00adti\u00adva de re\u00adgu\u00adla\u00adri\u00adzar e de\u00advol\u00adver o que \u00e9 de di\u00adrei\u00adto aos \u00adseus se\u00adgu\u00adra\u00addos pre\u00adju\u00addi\u00adca\u00addos? <\/p>\n<p>Prescreve o ar\u00adti\u00adgo 5\u00ba da nos\u00adsa Carta Magna de 1.00088: <\/p>\n<p>Todos s\u00e3o \u00adiguais pe\u00adran\u00adte a lei, sem dis\u00adtin\u00ad\u00e7\u00e3o de qual\u00adquer na\u00adtu\u00adre\u00adza, ga\u00adran\u00adtin\u00addo-se aos bra\u00adsi\u00adlei\u00adros e aos es\u00adtran\u00adgei\u00adros re\u00adsi\u00adden\u00adtes no Pa\u00eds a in\u00advio\u00adla\u00adbi\u00adli\u00adda\u00adde do di\u00adrei\u00adto \u00e0 vi\u00adda, \u00e0 igual\u00adda\u00adde, \u00e0 se\u00adgu\u00adran\u00ad\u00e7a e a pro\u00adprie\u00adda\u00adde (&#8230;).<\/p>\n<p>Veja-se, por\u00adtan\u00adto, que o princ\u00edpio da igualdade tem se\u00adde ex\u00adpl\u00ed\u00adci\u00adta no tex\u00adto cons\u00adti\u00adtu\u00adcio\u00adnal, sen\u00addo men\u00adcio\u00adna\u00adda in\u00adclu\u00adsi\u00adve no pre\u00e2mbulo da Constitui\u00e7\u00e3o. Destarte, \u00e9 nor\u00adma su\u00adpra\u00adcons\u00adti\u00adtu\u00adcio\u00adnal e es\u00adta\u00admos dian\u00adte de um princ\u00edpio, pa\u00adra o \u00adqual to\u00addas as de\u00admais nor\u00admas de\u00advem obe\u00addi\u00ean\u00adcia.<\/p>\n<p>H\u00e1 que se va\u00adler, por\u00adtan\u00adto, do princ\u00edpio da isonomia ou igualdade, no mo\u00admen\u00adto da ela\u00adbo\u00adra\u00ad\u00e7\u00e3o da lei, apre\u00adsen\u00adta\u00addo-se is\u00adto co\u00admo al\u00adgo l\u00f3\u00adgi\u00adco e coe\u00adren\u00adte.<\/p>\n<p>Se em \u00e9po\u00adcas di\u00adfe\u00adren\u00adtes, se es\u00adta\u00adbe\u00adle\u00adce\u00adram va\u00adlo\u00adres e pa\u00adr\u00e2\u00adme\u00adtros di\u00adfe\u00adren\u00adtes pa\u00adra um mes\u00admo ca\u00adso, ne\u00adces\u00ads\u00e1\u00adrio e per\u00adti\u00adnen\u00adte que se fa\u00ad\u00e7a a ade\u00adqua\u00ad\u00e7\u00e3o dos ca\u00adsos an\u00adte\u00adrio\u00adres \u00e0 rea\u00adli\u00adda\u00adde \u00adatual, sob pe\u00adna de pro\u00addu\u00adzir-se uma ins\u00adta\u00adbi\u00adli\u00adda\u00adde so\u00adcial.<\/p>\n<p>A pres\u00adta\u00ad\u00e7\u00e3o con\u00adti\u00adnua\u00adda da autora, de\u00adno\u00admi\u00adna\u00adda aux\u00edlio-doen\u00e7a, tem cu\u00adnho ali\u00admen\u00adtar, de so\u00adbre\u00advi\u00adv\u00ean\u00adcia e n\u00e3o \u00e9 de for\u00adma al\u00adgu\u00adma di\u00adfe\u00adren\u00adte dos be\u00adne\u00adf\u00ed\u00adcios con\u00adce\u00addi\u00addos aos in\u00adca\u00adpa\u00adci\u00adta\u00addos an\u00adte\u00adrior\u00admen\u00adte \u00e0 vi\u00adg\u00ean\u00adcia da MP e atual\u00admen\u00adte, de\u00adpois de sua re\u00advo\u00adga\u00ad\u00e7\u00e3o, ou se\u00adja, cal\u00adcu\u00adla\u00addas em um Plano B\u00e1sico de C\u00e1lculo abran\u00adgen\u00addo ape\u00adnas os \u00fal\u00adti\u00admos 36 me\u00adses de con\u00adtri\u00adbui\u00ad\u00e7\u00e3o e n\u00e3o uma boa par\u00adte da vi\u00adda con\u00adtri\u00adbu\u00adti\u00adva, con\u00adfor\u00adme pre\u00adcei\u00adtua a Lei 000876\/000000, is\u00adto \u00e9, 80% dos maio\u00adres sa\u00adl\u00e1\u00adrios de con\u00adtri\u00adbui\u00ad\u00e7\u00e3o des\u00adde ju\u00adlho de 10000004.<\/p>\n<p>\u00c9 ce\u00addi\u00ad\u00e7o que a lei pre\u00advi\u00adden\u00adci\u00e1\u00adria, de ca\u00adr\u00e1\u00adter emi\u00adnen\u00adte\u00admen\u00adte so\u00adcial, des\u00adti\u00adna-se a pro\u00adte\u00adger os se\u00adgu\u00adra\u00addos, as\u00adse\u00adgu\u00adran\u00addo-\u00adlhes o di\u00adrei\u00adto \u00e0 per\u00adcep\u00ad\u00e7\u00e3o de be\u00adne\u00adf\u00ed\u00adcios que se jus\u00adti\u00adfi\u00adca\u00adti\u00adva de evi\u00adtar frau\u00addes e o au\u00admen\u00adto do vo\u00adlu\u00adme de con\u00adces\u00ads\u00e3o de be\u00adne\u00adf\u00ed\u00adcios.<\/p>\n<p>Sendo a nor\u00adma de di\u00adrei\u00adto p\u00fa\u00adbli\u00adco, de\u00adve com\u00adpor\u00adtar in\u00adter\u00adpre\u00adta\u00ad\u00e7\u00e3o ex\u00adten\u00adsi\u00adva, n\u00e3o ha\u00adven\u00addo am\u00adpa\u00adro pa\u00adra per\u00adpe\u00adtrar uma dis\u00adcri\u00admi\u00adna\u00ad\u00e7\u00e3o en\u00adtre nor\u00admas ge\u00adrais de con\u00adces\u00ads\u00e3o de be\u00adne\u00adf\u00ed\u00adcios, de\u00advem tu\u00adte\u00adlar a to\u00addos os be\u00adne\u00adfi\u00adci\u00e1\u00adrios da Pre\u00advi\u00add\u00ean\u00adcia, sem ex\u00adce\u00ad\u00e7\u00e3o, sem que se ale\u00adgue agres\u00ads\u00e3o a di\u00adrei\u00adto ad\u00adqui\u00adri\u00addo ou ato ju\u00adr\u00ed\u00addi\u00adco per\u00adfei\u00adto.<\/p>\n<p>Dentro des\u00adsa vi\u00ads\u00e3o te\u00adleo\u00adl\u00f3\u00adgi\u00adca, n\u00e3o h\u00e1 por\u00adque a autora per\u00adma\u00adne\u00adcer com o va\u00adlor do be\u00adne\u00adf\u00ed\u00adcio aux\u00edlio-doen\u00e7a no mes\u00admo pa\u00adta\u00admar que \u00e0 \u00e9po\u00adca da MP, sen\u00addo que os be\u00adne\u00adf\u00ed\u00adcios da mes\u00adma es\u00adp\u00e9\u00adcie t\u00eam um va\u00adlor \u00admaior com ba\u00adse em um c\u00e1l\u00adcu\u00adlo di\u00adfe\u00adren\u00adcia\u00addo e que re\u00adsul\u00adta em va\u00adlor \u00admaior de be\u00adne\u00adf\u00ed\u00adcio, pos\u00adto que n\u00e3o con\u00adce\u00addi\u00addos na vi\u00adg\u00ean\u00adcia da fa\u00admi\u00adge\u00adra\u00adda MP.<\/p>\n<p>\u00c9 in\u00addis\u00adso\u00adci\u00e1\u00advel o be\u00adne\u00adf\u00ed\u00adcio pre\u00advi\u00adden\u00adci\u00e1\u00adrio das ne\u00adces\u00adsi\u00adda\u00addes vi\u00adtais b\u00e1\u00adsi\u00adcas da pes\u00adsoa hu\u00adma\u00adna, e a MP, por ser pre\u00adju\u00addi\u00adcial e n\u00e3o ha\u00adver si\u00addo con\u00adva\u00adli\u00adda\u00adda pe\u00adlos re\u00adpre\u00adsen\u00adtan\u00adtes do po\u00advo, de\u00adve ser ex\u00adpe\u00adli\u00adda de\u00adfi\u00adni\u00adti\u00adva\u00admen\u00adte, com efei\u00adto ime\u00addia\u00adto e ge\u00adral, al\u00adcan\u00ad\u00e7an\u00addo as re\u00adla\u00ad\u00e7\u00f5es ju\u00adr\u00ed\u00addi\u00adcas a \u00adquem atin\u00adgiu.<\/p>\n<p>Al\u00e9m do princ\u00edpio da isonomia ou igualdade, tam\u00adb\u00e9m de\u00adve-se con\u00adsi\u00adde\u00adrar que a Administra\u00e7\u00e3o P\u00fablica de\u00adve se pau\u00adtar pe\u00adla legalidade. E tal princ\u00edpio tam\u00adb\u00e9m vem es\u00adcul\u00adpi\u00addo em nos\u00adsa Constitui\u00e7\u00e3o, no ar\u00adti\u00adgo 37, caput.<\/p>\n<p>\u00c9 fun\u00adda\u00admen\u00adto b\u00e1\u00adsi\u00adco de Direito P\u00fablico que a Administra\u00e7\u00e3o, no exer\u00adc\u00ed\u00adcio de \u00adsuas ati\u00advi\u00adda\u00addes, n\u00e3o po\u00adde pro\u00adce\u00adder com a mes\u00adma de\u00adsen\u00advol\u00adtu\u00adra e li\u00adber\u00adda\u00adde com que \u00adagem os par\u00adti\u00adcu\u00adla\u00adres, ocu\u00adpa\u00addos na de\u00adfe\u00adsa dos pr\u00f3\u00adprios in\u00adte\u00adres\u00adses e con\u00adve\u00adni\u00ean\u00adcias. <\/p>\n<p>Enquanto na ad\u00admi\u00adnis\u00adtra\u00ad\u00e7\u00e3o par\u00adti\u00adcu\u00adlar \u00e9 l\u00ed\u00adci\u00adto fa\u00adzer tu\u00addo que a lei n\u00e3o pro\u00ed\u00adbe, na Administra\u00e7\u00e3o P\u00fablica s\u00f3 \u00e9 per\u00admi\u00adti\u00addo fa\u00adzer o que a lei au\u00adto\u00adri\u00adza. <\/p>\n<p>Por es\u00adsa ra\u00adz\u00e3o, o agen\u00adte p\u00fa\u00adbli\u00adco, no de\u00adsem\u00adpe\u00adnho da fun\u00ad\u00e7\u00e3o es\u00adta\u00adtal, de\u00adve\u00adr\u00e1 pau\u00adtar sua con\u00addu\u00adta de acor\u00addo com os co\u00adman\u00addos da lei, sob pe\u00adna de \u00adtrair o in\u00adte\u00adres\u00adse p\u00fa\u00adbli\u00adco, cu\u00adjo res\u00adguar\u00addo jus\u00adti\u00adfi\u00adca a pr\u00f3\u00adpria exis\u00adt\u00ean\u00adcia do Estado.<\/p>\n<p>A me\u00addi\u00adda pro\u00advi\u00ads\u00f3\u00adria n\u00e3o \u00e9 lei, \u00e9 ato que tem a for\u00ad\u00e7a da lei. Por que n\u00e3o \u00e9 lei? Porque lei \u00e9 ato nas\u00adci\u00addo no Poder Legislativo que se sub\u00adme\u00adte a um re\u00adgi\u00adme ju\u00adr\u00ed\u00addi\u00adco pre\u00adde\u00adter\u00admi\u00adna\u00addo na Constitui\u00e7\u00e3o, ca\u00adpaz de ino\u00advar ori\u00adgi\u00adna\u00adria\u00admen\u00adte a or\u00addem ju\u00adr\u00ed\u00addi\u00adca, ou se\u00adja, \u00adcriar di\u00adrei\u00adtos e de\u00adve\u00adres.<\/p>\n<p>Tem a for\u00ad\u00e7a de lei, em\u00adbo\u00adra ema\u00adne de uma \u00fani\u00adca pes\u00adsoa, \u00e9 uni\u00adpes\u00adsoal, n\u00e3o \u00e9 fru\u00adto da re\u00adpre\u00adsen\u00adta\u00ad\u00e7\u00e3o po\u00adpu\u00adlar, es\u00adta\u00adbe\u00adle\u00adci\u00adda no art 1\u00ba, pa\u00adr\u00e1\u00adgra\u00adfo \u00fani\u00adco da Constitui\u00e7\u00e3o, que afir\u00adma que to\u00addo po\u00adder ema\u00adna do po\u00advo.<\/p>\n<p>O Governo abu\u00adsa des\u00adse ins\u00adti\u00adtu\u00adto por\u00adque, uma vez edi\u00adta\u00adda, a MP t\u00eam va\u00adli\u00adda\u00adde le\u00adgal at\u00e9 que se\u00adja apro\u00adva\u00adda pe\u00adlo Parlamento e con\u00adver\u00adti\u00adda em lei. Como n\u00e3o \u00e9 vo\u00adta\u00adda, \u00e9 ree\u00addi\u00adta\u00adda su\u00adces\u00adsi\u00adva\u00admen\u00adte e, a ca\u00adda ree\u00addi\u00ad\u00e7\u00e3o, o Executivo mo\u00addi\u00adfi\u00adca o tex\u00adto co\u00admo lhe con\u00adv\u00e9m.<\/p>\n<p>Ora, se qual\u00adquer pro\u00adje\u00adto-de-lei de ini\u00adcia\u00adti\u00adva do Poder Executivo de\u00adve ser vo\u00adta\u00addo em 45 \u00addias pe\u00adlo Congresso, co\u00admo jus\u00adti\u00adfi\u00adcar que uma me\u00addi\u00adda pro\u00advi\u00ads\u00f3\u00adria, ex\u00adcep\u00adcio\u00adnal\u00admen\u00adte per\u00admi\u00adti\u00adda co\u00admo ins\u00adtru\u00admen\u00adto de ini\u00adcia\u00ad\u00e7\u00e3o de lei, em ca\u00adr\u00e1\u00adter de ur\u00adg\u00ean\u00adcia, dei\u00adte \u00adseus efei\u00adtos tran\u00adsi\u00adt\u00f3\u00adrios in\u00adde\u00adfi\u00adni\u00adda\u00admen\u00adte por me\u00adses e at\u00e9 \u00adanos a fio sem qual\u00adquer apre\u00adcia\u00ad\u00e7\u00e3o do Poder com\u00adpe\u00adten\u00adte?<\/p>\n<p>A \u00adquem ca\u00adbe, po\u00adr\u00e9m, di\u00adzer so\u00adbre a ur\u00adg\u00ean\u00adcia da ma\u00adt\u00e9\u00adria ob\u00adje\u00adto da me\u00addi\u00adda pro\u00advi\u00ads\u00f3\u00adria? <\/p>\n<p>Entendemos que o pres\u00adsu\u00adpos\u00adto da ur\u00adg\u00ean\u00adcia, bem co\u00admo o da re\u00adle\u00adv\u00e2n\u00adcia com\u00adpor\u00adtam exa\u00adme po\u00adl\u00ed\u00adti\u00adco e ju\u00adr\u00ed\u00addi\u00adco, su\u00adjei\u00adto, as\u00adsim, ao du\u00adplo cri\u00adt\u00e9\u00adrio de ava\u00adlia\u00ad\u00e7\u00e3o pe\u00adlo Congresso e pe\u00adlo Judici\u00e1rio.<\/p>\n<p>Essa in\u00adde\u00advi\u00adda ocu\u00adpa\u00ad\u00e7\u00e3o, pe\u00adlo Poder Executivo, do es\u00adpa\u00ad\u00e7o cons\u00adti\u00adtu\u00adcio\u00adnal\u00admen\u00adte re\u00adser\u00adva\u00addo \u00e0 atua\u00ad\u00e7\u00e3o do Congresso pro\u00advo\u00adca gra\u00adves dis\u00adtor\u00ad\u00e7\u00f5es de ca\u00adr\u00e1\u00adter po\u00adl\u00ed\u00adti\u00adco-ju\u00adr\u00ed\u00addi\u00adco, \u00adpois as me\u00addi\u00addas pro\u00advi\u00ads\u00f3\u00adrias n\u00e3o fo\u00adram con\u00adce\u00adbi\u00addas pe\u00adla Assembl\u00e9ia Constituinte co\u00admo ins\u00adtru\u00admen\u00adtos or\u00addi\u00adn\u00e1\u00adrios de subs\u00adti\u00adtui\u00ad\u00e7\u00e3o da ati\u00advi\u00adda\u00adde le\u00adgis\u00adla\u00adti\u00adva co\u00admum do Congresso Nacional.<\/p>\n<p>O uso com\u00adpul\u00adsi\u00advo de me\u00addi\u00addas pro\u00advi\u00ads\u00f3\u00adrias, \u00adal\u00e9m de ca\u00adrac\u00adte\u00adri\u00adzar abu\u00adso no exer\u00adc\u00ed\u00adcio de uma com\u00adpe\u00adt\u00ean\u00adcia ex\u00adtraor\u00addi\u00adn\u00e1\u00adria ou\u00adtor\u00adga\u00adda pe\u00adla Carta Magna ao presidente da Rep\u00fablica, re\u00adve\u00adla-se fa\u00adtor que de\u00adfor\u00adma o sen\u00adti\u00addo de\u00admo\u00adcr\u00e1\u00adti\u00adco das ins\u00adti\u00adtui\u00ad\u00e7\u00f5es. <\/p>\n<p>E \u00adaqui le\u00advan\u00adta-se a ques\u00adt\u00e3o \u00admais re\u00adle\u00advan\u00adte so\u00adbre as MPs, que \u00e9 a sua va\u00adli\u00adda\u00adde no pe\u00adr\u00edo\u00addo em que vi\u00adgo\u00adrou, mes\u00admo de\u00adpois de re\u00advo\u00adga\u00adda e der\u00adru\u00adba\u00adda.<\/p>\n<p>Se a MP n\u00e3o foi con\u00adva\u00adli\u00adda\u00adda pe\u00adlo Congresso ou Senado, e foi at\u00e9 sus\u00adpen\u00adsa a sua efi\u00adc\u00e1\u00adcia me\u00addian\u00adte \u00ada\u00e7\u00e3o do Supremo Tribunal Federal, a sua va\u00adli\u00adda\u00adde no pe\u00adr\u00edo\u00addo tem \u00adqual re\u00adsul\u00adta\u00addo na so\u00adcie\u00adda\u00adde? Remetendo ao que de\u00adci\u00addi\u00addo na Medida Cautelar na A\u00e7\u00e3o Direta de Inconstitucionalidade n\u00ba 20003-7 e ao vo\u00adto pro\u00adfe\u00adri\u00addo pe\u00adlo mi\u00adnis\u00adtro Celso de Mello, afir\u00adma o re\u00adque\u00adren\u00adte n\u00e3o se con\u00adtar com ba\u00adse f\u00e1\u00adti\u00adca pa\u00adra al\u00adte\u00adrar-se, me\u00addian\u00adte me\u00addi\u00adda pro\u00advi\u00ads\u00f3\u00adria, a Lei n\u00ba 8.213\/0001. Aponta a cir\u00adcuns\u00adt\u00e2n\u00adcia de n\u00e3o se ter ob\u00adser\u00adva\u00addo o \u00a7 000\u00ba do ar\u00adti\u00adgo 62 da Constitui\u00e7\u00e3o federal, no to\u00adcan\u00adte \u00e0 obri\u00adga\u00adto\u00adrie\u00adda\u00adde da emis\u00ads\u00e3o de pa\u00adre\u00adcer da Comiss\u00e3o Mista de Deputados e Senadores.<\/p>\n<p>Sob o \u00e2n\u00adgu\u00adlo ma\u00adte\u00adrial, \u00adap\u00f3s co\u00adte\u00adjo da nor\u00adma\u00adti\u00advi\u00adda\u00adde mo\u00addi\u00adfi\u00adca\u00adda com a de\u00adcor\u00adren\u00adte da me\u00addi\u00adda pro\u00advi\u00ads\u00f3\u00adria, as\u00adse\u00adve\u00adra a con\u00adfi\u00adgu\u00adra\u00ad\u00e7\u00e3o de re\u00adtro\u00adces\u00adso so\u00adcial. \u00c9 que o c\u00e1l\u00adcu\u00adlo do au\u00adx\u00ed\u00adlio-doen\u00ad\u00e7a dei\u00adxa\u00adra de ser fei\u00adto pe\u00adla m\u00e9\u00addia arit\u00adm\u00e9\u00adti\u00adca sim\u00adples dos maio\u00adres sa\u00adl\u00e1\u00adrios-de-con\u00adtri\u00adbui\u00ad\u00e7\u00e3o, cor\u00adres\u00adpon\u00adden\u00adtes a 80% de to\u00addo o pe\u00adr\u00edo\u00addo con\u00adtri\u00adbu\u00adti\u00advo \u2013 ar\u00adti\u00adgo 2000, in\u00adci\u00adso II, da Lei n\u00ba 8.213\/0001 \u2013, pa\u00adra con\u00adsi\u00adde\u00adrar-se a m\u00e9\u00addia arit\u00adm\u00e9\u00adti\u00adca sim\u00adples dos 36 \u00fal\u00adti\u00admos sa\u00adl\u00e1\u00adrios-de-con\u00adtri\u00adbui\u00ad\u00e7\u00e3o ou, n\u00e3o al\u00adcan\u00ad\u00e7an\u00addo es\u00adse li\u00admi\u00adte, a m\u00e9\u00addia arit\u00adm\u00e9\u00adti\u00adca sim\u00adples dos sa\u00adl\u00e1\u00adrios-de-con\u00adtri\u00adbui\u00ad\u00e7\u00e3o exis\u00adten\u00adtes \u2013 in\u00adci\u00adso III, acres\u00adcen\u00adta\u00addo ao ar\u00adti\u00adgo 2000 da Lei n\u00ba 8.213\/0001 pe\u00adla me\u00addi\u00adda pro\u00advi\u00ads\u00f3\u00adria. Diz o \u00adPSDB que os tra\u00adba\u00adlha\u00addo\u00adres, mor\u00admen\u00adte os me\u00adnos afor\u00adtu\u00adna\u00addos, os bra\u00ad\u00e7ais, \u00aderam be\u00adne\u00adfi\u00adcia\u00addos pe\u00adla to\u00adma\u00adda de pe\u00adr\u00edo\u00addo de con\u00adtri\u00adbui\u00ad\u00e7\u00e3o quan\u00addo de\u00adten\u00adto\u00adres de for\u00ad\u00e7a la\u00adbo\u00adra\u00adti\u00adva \u00admaior, pres\u00adsu\u00adpon\u00addo-se me\u00adlhor re\u00admu\u00adne\u00adra\u00ad\u00e7\u00e3o. Tamb\u00e9m pe\u00adlo tex\u00adto an\u00adte\u00adrior, o au\u00adx\u00ed\u00adlio-doen\u00ad\u00e7a po\u00adde\u00adria su\u00adpe\u00adrar o sa\u00adl\u00e1\u00adrio por \u00fal\u00adti\u00admo per\u00adce\u00adbi\u00addo, o que \u00adveio a ser ve\u00adda\u00addo pe\u00adlo \u00a7 10 do ar\u00adti\u00adgo 2000 da Lei n\u00ba 8.213\/0001, acres\u00adcen\u00adta\u00addo pe\u00adla me\u00addi\u00adda pro\u00advi\u00ads\u00f3\u00adria em exa\u00adme.<\/p>\n<p>&#8230;<\/p>\n<p>Ent\u00e3o, des\u00adpa\u00adchei:<\/p>\n<p>(&#8230;)<\/p>\n<p>2. Ante o en\u00advol\u00advi\u00admen\u00adto de ins\u00adti\u00adtu\u00adto a co\u00adlo\u00adcar em ris\u00adco a sub\u00adsis\u00adt\u00ean\u00adcia do tra\u00adba\u00adlha\u00addor \u2013 o au\u00adx\u00ed\u00adlio-doen\u00ad\u00e7a \u2013, re\u00adcon\u00adsi\u00adde\u00adro o ato re\u00adla\u00adti\u00advo ao jul\u00adga\u00admen\u00adto fi\u00adnal. Solicitem-se in\u00adfor\u00adma\u00ad\u00e7\u00f5es ao re\u00adque\u00adri\u00addo pa\u00adra exa\u00adme da li\u00admi\u00adnar.<\/p>\n<p>Os pre\u00adcei\u00adtos cons\u00adtan\u00adtes da me\u00addi\u00adda pro\u00advi\u00ads\u00f3\u00adria s\u00e3o con\u00addu\u00adcen\u00adtes a con\u00adcluir-se pe\u00adla mo\u00addi\u00adfi\u00adca\u00ad\u00e7\u00e3o dos pa\u00adr\u00e2\u00adme\u00adtros alu\u00adsi\u00advos \u00e0 aqui\u00adsi\u00ad\u00e7\u00e3o do be\u00adne\u00adf\u00ed\u00adcio \u2013 au\u00adx\u00ed\u00adlio-doen\u00ad\u00e7a. Em s\u00edn\u00adte\u00adse, acio\u00adnou-se per\u00admis\u00adsi\u00advo, a en\u00adcer\u00adrar ex\u00adce\u00ad\u00e7\u00e3o, da Lei Fundamental \u2013 o ins\u00adtru\u00admen\u00adto, ao pri\u00admei\u00adro pas\u00adso e sem pre\u00adju\u00ed\u00adzo da nor\u00adma\u00adti\u00advi\u00adda\u00adde, mo\u00adno\u00adcr\u00e1\u00adti\u00adco da Medida Provis\u00f3ria \u2013, pa\u00adra mu\u00addar as ba\u00adli\u00adzas do sis\u00adte\u00adma de be\u00adne\u00adf\u00ed\u00adcio. Vislumbraram-se re\u00adle\u00adv\u00e2n\u00adcia e ur\u00adg\u00ean\u00adcia na res\u00adtri\u00ad\u00e7\u00e3o do au\u00adx\u00ed\u00adlio-doen\u00ad\u00e7a. Desprezou-se a ne\u00adces\u00adsi\u00adda\u00adde de as al\u00adte\u00adra\u00ad\u00e7\u00f5es, an\u00adtes de sur\u00adti\u00adrem efei\u00adto, pas\u00adsa\u00adrem pe\u00adlo cri\u00advo dos re\u00adpre\u00adsen\u00adtan\u00adtes do po\u00advo \u2013 de\u00adpu\u00adta\u00addos fe\u00adde\u00adrais \u2013 e dos re\u00adpre\u00adsen\u00adtan\u00adtes dos Estados \u2013 se\u00adna\u00addo\u00adres da Rep\u00fablica. Entendeu-se pos\u00ads\u00ed\u00advel pres\u00adcin\u00addir da lei em sen\u00adti\u00addo for\u00admal e ma\u00adte\u00adrial, ol\u00advi\u00addan\u00addo-se, at\u00e9 mes\u00admo, a pos\u00adsi\u00adbi\u00adli\u00adda\u00adde de se en\u00adca\u00admi\u00adnhar pro\u00adje\u00adto-de-lei, re\u00adque\u00adren\u00addo, o excelent\u00edssimo senhor presidente da Rep\u00fablica, a ur\u00adg\u00ean\u00adcia dis\u00adci\u00adpli\u00adna\u00adda no ar\u00adti\u00adgo 64 da Constitui\u00e7\u00e3o federal. Tudo foi fei\u00adto con\u00adsi\u00adde\u00adra\u00adda a qua\u00addra de\u00adfi\u00adci\u00adt\u00e1\u00adria da Previd\u00eancia Social \u2013 que n\u00e3o \u00e9 de ho\u00adje e que tem ori\u00adgem n\u00e3o na ou\u00adtor\u00adga do be\u00adne\u00adf\u00ed\u00adcio au\u00adx\u00ed\u00adlio-doen\u00ad\u00e7a a tra\u00adba\u00adlha\u00addo\u00adres que a ele ti\u00adves\u00adsem jus, de acor\u00addo com a Lei n\u00ba 8.213\/0001, mas em dis\u00adtor\u00ad\u00e7\u00f5es de to\u00adda a or\u00addem, sem le\u00advar em con\u00adta as frau\u00addes que cus\u00adtam a ser coi\u00adbi\u00addas.<\/p>\n<p>Portanto, Excel\u00eancia, a autora faz jus ao no\u00advo re\u00adc\u00e1l\u00adcu\u00adlo de seu be\u00adne\u00adf\u00ed\u00adcio pe\u00adlos ar\u00adgu\u00admen\u00adtos apre\u00adsen\u00adta\u00addos, re\u00adque\u00adren\u00addo a apli\u00adca\u00ad\u00e7\u00e3o da lei an\u00adte\u00adrior \u00e0 edi\u00ad\u00e7\u00e3o da MP, pe\u00adlo princ\u00edpio da isonomia e igualdade e tam\u00adb\u00e9m pe\u00adlo princ\u00edpio da legalidade, pos\u00adto que MP n\u00e3o \u00e9 lei, ain\u00adda \u00admais quan\u00addo n\u00e3o con\u00adva\u00adli\u00adda\u00adda pe\u00adlo Le\u00adgis\u00adla\u00adti\u00advo. <\/p>\n<p>III \u2013 DA AN\u00adTE\u00adCI\u00adPA\u00ad\u00c7\u00c3O DOS EFEI\u00adTOS DA TU\u00adTE\u00adLA<\/p>\n<p>\u00ad<\/p>\n<p>Com ful\u00adcro no ar\u00adti\u00adgo 273, do CPC, re\u00adquer a autora, a an\u00adte\u00adci\u00adpa\u00ad\u00e7\u00e3o dos efei\u00adtos da tu\u00adte\u00adla, \u00adpois de\u00admons\u00adtra\u00addo pri\u00admei\u00adro que h\u00e1 o fun\u00adda\u00addo re\u00adceio de ocor\u00adr\u00ean\u00adcia de da\u00adno ir\u00adre\u00adpa\u00adr\u00e1\u00advel pe\u00adlo n\u00e3o re\u00adce\u00adbi\u00admen\u00adto des\u00adde j\u00e1, e an\u00adtes da de\u00adci\u00ads\u00e3o de\u00adfi\u00adni\u00adti\u00adva de m\u00e9\u00adri\u00adto, do be\u00adne\u00adf\u00ed\u00adcio men\u00adsal de aux\u00edlio-doen\u00e7a no va\u00adlor cor\u00adre\u00adto pe\u00adla apli\u00adca\u00ad\u00e7\u00e3o das Leis 8213\/0001 e 000876\/000000, de\u00advi\u00addo \u00e0 gran\u00adde di\u00adfi\u00adcul\u00adda\u00adde em con\u00adse\u00adguir pa\u00adgar \u00adsuas con\u00adtas, bem co\u00admo se ali\u00admen\u00adtar ou se me\u00addi\u00adcar ade\u00adqua\u00adda\u00admen\u00adte pe\u00adlas des\u00adpe\u00adsas que vem a seu en\u00adcon\u00adtro em vir\u00adtu\u00adde de sua en\u00adfer\u00admi\u00adda\u00adde. Temer\u00e1rio se\u00adria aguar\u00addar o jul\u00adga\u00admen\u00adto fi\u00adnal da \u00ada\u00e7\u00e3o, ha\u00adja vis\u00adto, ser no\u00adt\u00f3\u00adria e p\u00fa\u00adbli\u00adca a cons\u00adtan\u00adte e in\u00adsis\u00adten\u00adte pr\u00e1\u00adti\u00adca do Ins\u00adti\u00adtu\u00adto-r\u00e9u em pro\u00adte\u00adlar pa\u00adga\u00admen\u00adtos e re\u00advi\u00ads\u00e3o de be\u00adne\u00adf\u00ed\u00adcios, \u00adal\u00e9m dos in\u00fa\u00adme\u00adros re\u00adcur\u00adsos e pra\u00adzos da\u00addos \u00e0 Autarquia.<\/p>\n<p>Tamb\u00e9m pro\u00adva\u00adda a ve\u00adros\u00adsi\u00admi\u00adlhan\u00ad\u00e7a da ale\u00adga\u00ad\u00e7\u00e3o pe\u00adla autora, tra\u00adzen\u00addo aos au\u00adtos, a de\u00admons\u00adtra\u00ad\u00e7\u00e3o f\u00e1\u00adti\u00adca da le\u00adgis\u00adla\u00ad\u00e7\u00e3o a ser uti\u00adli\u00adza\u00adda em seu c\u00e1l\u00adcu\u00adlo de be\u00adne\u00adf\u00ed\u00adcio.<\/p>\n<p>Da mes\u00adma for\u00adma, fi\u00adca de\u00admons\u00adtra\u00addo e ca\u00adrac\u00adte\u00adri\u00adza\u00addo o fu\u00admus bo\u00adni iu\u00adris, pe\u00adla apli\u00adca\u00ad\u00e7\u00e3o dos di\u00adrei\u00adtos pre\u00advis\u00adtos em nos\u00adsa Constitui\u00e7\u00e3o, pre\u00adven\u00addo o princ\u00edpio da isonomia e igualdade e legalidade.<\/p>\n<p>IV \u2013 DO PE\u00adDI\u00adDO<\/p>\n<p>Diante de to\u00addo o ex\u00adpos\u00adto, re\u00adquer se\u00adja a Autarquia ci\u00adta\u00adda e in\u00adti\u00adma\u00adda, na pes\u00adsoa de seu re\u00adpre\u00adsen\u00adtan\u00adte ju\u00addi\u00adcial, no en\u00adde\u00adre\u00ad\u00e7o de\u00adcli\u00adna\u00addo no pre\u00e2m\u00adbu\u00adlo pa\u00adra, que\u00adren\u00addo, apre\u00adsen\u00adtar a con\u00adtes\u00adta\u00ad\u00e7\u00e3o que en\u00adten\u00adder ca\u00adb\u00ed\u00advel, de\u00adven\u00addo a de\u00adman\u00adda, ao fi\u00adnal, ser jul\u00adga\u00adda pro\u00adce\u00adden\u00adte, con\u00adde\u00adnan\u00addo-a a re\u00advi\u00adsar o be\u00adne\u00adf\u00ed\u00adcio aux\u00edlio-doen\u00e7a da autora, con\u00adfor\u00adme a le\u00adgis\u00adla\u00ad\u00e7\u00e3o an\u00adte\u00adrior \u00e0 MP n\u00ba 242, e pa\u00adgar os va\u00adlo\u00adres atra\u00adsa\u00addos des\u00adde 10 de \u00admaio de 2012, da\u00adta da con\u00adces\u00ads\u00e3o do be\u00adne\u00adf\u00ed\u00adcio, em ca\u00adso do de\u00adfe\u00adri\u00admen\u00adto da tu\u00adte\u00adla an\u00adte\u00adci\u00adpa\u00adt\u00f3\u00adria.<\/p>\n<p>Pelos mo\u00adti\u00advos ex\u00adpos\u00adtos, re\u00adquer a an\u00adte\u00adci\u00adpa\u00ad\u00e7\u00e3o dos efei\u00adtos da tu\u00adte\u00adla, com ful\u00adcro no ar\u00adti\u00adgo 273 do CPC, re\u00advi\u00adsan\u00addo o va\u00adlor do be\u00adne\u00adf\u00ed\u00adcio e de ime\u00addia\u00adto reim\u00adplan\u00adtan\u00addo o no\u00advo va\u00adlor.<\/p>\n<p>Requer, ou\u00adtros\u00adsim, que lhe se\u00adja con\u00adce\u00addi\u00adda a Assist\u00eancia Judici\u00e1ria gra\u00adtui\u00adta dian\u00adte da sua con\u00addi\u00ad\u00e7\u00e3o, e por for\u00ad\u00e7a da na\u00adtu\u00adre\u00adza da cau\u00adsa, que tem cu\u00adnho ali\u00admen\u00adtar.<\/p>\n<p>Ademais, re\u00adquer a con\u00adde\u00adna\u00ad\u00e7\u00e3o ao pa\u00adga\u00admen\u00adto das di\u00adfe\u00adren\u00ad\u00e7as en\u00adcon\u00adtra\u00addas en\u00adtre o no\u00advo va\u00adlor, e o va\u00adlor efe\u00adti\u00adva\u00admen\u00adte pa\u00adgo at\u00e9 a sen\u00adten\u00ad\u00e7a de\u00adfi\u00adni\u00adti\u00adva, atua\u00adli\u00adza\u00addas com a in\u00adci\u00add\u00ean\u00adcia da cor\u00adre\u00ad\u00e7\u00e3o mo\u00adne\u00adt\u00e1\u00adria con\u00adfor\u00adme a S\u00famula n\u00ba 148 do E.
