Apenas para esclarecer, a \ufffdrea de produ\ufffd\ufffdo \ufffd composta pelos seguintes setores: digita\ufffd\ufffdo cobra 400, despacho, consist\ufffdncia e opera\ufffd\ufffdo B 2.900.Por sua vez as CCTs da categoria, documentos em anexo, sempre foram da seguinte ordem com rela\ufffd\ufffdo \ufffd jornada laboral dos empregados em setor de produ\ufffd\ufffdo:CCT 88\/89 Cl\ufffdusulas 4\ufffd:JORNADA DE TRABALHOAs empresas com setores de produ\ufffd\ufffdo e que:a) Na data base desta conven\ufffd\ufffdo praticarem, o regime de trabalho semanal de trinta e seis horas, continuar\ufffdo a faz\ufffd-lo;b) Na data base desta conven\ufffd\ufffdo praticam a carga hor\ufffdria semanal de trinta horas, no setor de produ\ufffd\ufffdo, manter\ufffdo o regime;c) Surgirem ap\ufffds a data base desta conven\ufffd\ufffdo ou que praticarem jornada diferente das acima, ficam obrigadas a uma jornada de trinta horas semanais no setor de produ\ufffd\ufffdo.CCT 89\/90 Cl\ufffdusulas 4\ufffd doc 122:JORNADA DE TRABALHOAs empresas com setores de produ\ufffd\ufffdo e que:a) Na data base de &#8230;., praticarem o regime de trabalho semanal de trinta e seis horas, continuar\ufffdo a faz\ufffd-lo, sendo distribu\ufffdda da seguinte forma: seis horas por dia e seis dias por semana.b) Na data base de &#8230;., praticarem a carga hor\ufffdria semanal de trinta horas, no setor de produ\ufffd\ufffdo, manter\ufffdo o regime, sendo distribu\ufffdda da seguinte forma: seis horas por dia e cinco dias por semana;c) Surgirem ap\ufffds a data base de &#8230;., ou que praticarem jornadas diferente das acima, ficam obrigadas a uma jornada de trinta horas semanais no setor de produ\ufffd\ufffdo, conforme disposto nos itens acima.CCT 91\/92, doc. 124, Cl\ufffdusula 4\ufffdJORNADA DE TRABALHOA jornada de trabalho ser\ufffd de 30 (trinta) horas semanais, sendo 6(seis) horas di\ufffdrias em 5 (cinco) dias por semana, para as fun\ufffd\ufffdes e cargos do setor de Produ\ufffd\ufffdo a seguir: Digitador, Auxiliar de Processamento de dados, Operadores de Computadores, Operador de Teleprocessamento, Conferente, Atendente ao Usu\ufffdrio On-line, blocador, 6 Preparador de dados, Scheduller, Auxiliar e Operador Microgr\ufffdfico e Indexador.Cumpre esclarecer que nas fun\ufffd\ufffdes de Chefe de Digita\ufffd\ufffdo, quando a Reclamante n\ufffdo estava digitando, estava preparando dados aos seus subordinados, raz\ufffdo pela qual aplica-se-lhe a cl\ufffdusula supra.Isto posto, tem direito a Reclamante em receber as horas extraordin\ufffdrias laboradas e impagas pela Reclamada que excederem da 6 horas di\ufffdrias e 30 semanais at\ufffd &#8230;., com adicionais convencionais (Conven\ufffd\ufffdes Coletivas anexas), bem como aos seus reflexos em 13\ufffd sal\ufffdrio, aviso pr\ufffdvio, DSRs, f\ufffdrias e adicionais de f\ufffdrias, FGTS acrescido da multa de 40% e aviso pr\ufffdvio.03. DA PROJE\ufffd\ufffdO DO AVISO PR\ufffdVIOApesar de ter sido o aviso pr\ufffdvio indenizado, integra o tempo de servi\ufffdo, pois computa-se para todos os efeitos.A jurisprud\ufffdncia \ufffd interativa:&quot;Ainda que a parcela de aviso pr\ufffdvio tenha sido paga sob  a forma de indeniza\ufffd\ufffdo, a ordem de desligamento equivale, em face do disposto no par\ufffdgrafo 1\ufffd do art. 487 da CLT, \ufffd dispensa da  obriga\ufffd\ufffdo de prestar servi\ufffdos, sendo comput\ufffdvel o per\ufffdodo respectivo, em benef\ufffdcio do empregado.&quot; (TST, RR 8.425\/90.6, Manoel de Freitas, Ac. 3\ufffd T. 3.689\/91). O prazo do aviso pr\ufffdvio indenizado integra o tempo de servi\ufffdo do empregado, a teor do par\ufffdgrafo 1\ufffd do art. 487 da CLT. A data de sa\ufffdda a ser anotada &#8211; na Carteira de Trabalho, deve coincidir com o t\ufffdrmino do prazo do aviso-pr\ufffdvio, mesmo que indenizado &#8211; Revista n\ufffdo provida.&quot; (TST, RR 181\/90.3, Ant\ufffdnio Amaral, Ac. 3\ufffd T. 1.722\/90.1). DOS DESCONTOSA Reclamada mensalmente descontou do sal\ufffdrio da Reclamante import\ufffdncias a t\ufffdtulo de desc. Certiculbe, Sul &#8211; Am\ufffdrica seguros e Seg. Bandeirantes.Assim procedendo, a Reclamada feriu o disposto no art. 462 da CLT, que veda expressamente ao empregador efetuar qualquer desconto nos sal\ufffdrios do empregado.VALENTIN CARRION em sua obra Coment\ufffdrios \ufffd consolida\ufffd\ufffdo das leis do trabalho, 15\ufffd edi\ufffd\ufffdo, S\ufffdo Paulo, Editora Revista dos Tribunais, 1992, p\ufffdg. 314, \ufffd categ\ufffdrico:&quot;N\ufffdo podem ser descontadas dos sal\ufffdrios quaisquer outras import\ufffdncias, mesmo que o empregado o tenha autorizado por escrito, nem pagas a terceiros ainda que existindo procura\ufffd\ufffdo; \ufffd a\ufffd que se cristaliza a prote\ufffd\ufffdo do sal\ufffdrio contra os credores do trabalhador e contra sua pr\ufffdpria vontade, muitas vezes um fraco perante as vicissitudes da vida em geral.&quot;A empresa somente poderia efetuar os descontos alinhados pela Lei, pena de ferir-se o instituto da intatibilidade salarial.Assim, devem ser restitu\ufffddas ao Reclamante as import\ufffdncias descontadas de seu sal\ufffdrio.A jurisprud\ufffdncia espanca qualquer d\ufffdvida:&quot;DESCONTOS. DO ADICIONAL DE INSALUBRIDADEA Reclamante exercia suas atividades em local insalubre, pois em raz\ufffdo das condi\ufffd\ufffdes de trabalho fica exposta a agentes nocivos<\/p>\n<p> \ufffd sa\ufffdde, com certeza bastante acima dos limites toler\ufffdveis.Trabalhava no setor de produ\ufffd\ufffdo, na sala de digita\ufffd\ufffdo, onde havia ru\ufffddo excessivo, pois funcionavam duas impressoras durante todo o hor\ufffdrio de trabalho.Nesta sala havia at\ufffd dia &#8230;., &#8230;. CPUs, &#8230;. impressoras, &#8230;. monitores cobra 400 e &#8230;. monitores Data Entry, com &#8230;. condicionadores de ar, que por causa dos computadores mantinham entre 18 a 22 graus.De &#8230;. \ufffd &#8230;. a Reclamante ficava exposta a esses agentes durante mais de 8h di\ufffdrias; de &#8230;. at\ufffd a dispensa, ficava exposta durante mais de 6h di\ufffdrias.O adicional de insalubridade \ufffd devido de acordo com o grau de insalubridade (m\ufffdximo, m\ufffddio ou m\ufffdnimo), e consiste em um percentual vari\ufffdvel (40, 20 e 10%, respectivamente) sobre o sal\ufffdrio m\ufffdnimo da regi\ufffdo.Faz jus a Reclamante a receber o adicional de insalubridade, m\ufffds a m\ufffds, durante todo o contrato de trabalho, em seu grau m\ufffdximo (40%) sobre o sal\ufffdrio m\ufffdnimo, face ao grau de insalubridade a que ficava exposta.O adicional de insalubridade tem a natureza de sobre-sal\ufffdrio devendo integrar a remunera\ufffd\ufffdo da Reclamante para todos os efeitos legais. Desta feita, tem direito a Reclamante \ufffd incid\ufffdncia do adicional de insalubridade sobre horas extras, aviso pr\ufffdvio, 13\ufffd sal\ufffdrio, f\ufffdrias, adicional de f\ufffdrias, e FGTS acrescidos da multa de 40%, consoante entendimento da majorit\ufffdria jurisprud\ufffdncia:&quot;Incid\ufffdncia nas horas extras. O trabalho insalubre n\ufffdo deixa de s\ufffd-lo no hor\ufffdrio extraordin\ufffdrio. Pode-se mesmo afirmar que a jornada extra em servi\ufffdo insalubre \ufffd ainda mais penosa e prejudicial ao obreiro, pois ao peso do trabalho insalubre se soma o do servi\ufffdo al\ufffdm da jornada normal.&quot; (TST, RR 6.615\/89-5, Jos\ufffd Ajuricaba, Ac. 2\ufffd T., 1.866\/90.1). DO ART. 72 DA CLTAs Conven\ufffd\ufffdes Coletivas, em anexo, estabelecem que se obedecer\ufffd o intervalo para repouso previsto no art. 72 da CLT, para os empregados no trabalho de digita\ufffd\ufffdo, frente terminal de v\ufffddeo e na confer\ufffdncia de controle de dados.O art. 72 da CLT prescreve um repouso de 10 minutos n\ufffdo deduzidos da dura\ufffd\ufffdo norma de trabalho a cada per\ufffdodo de 90 minutos de trabalho consecutivo.Embora a Reclamante trabalhasse no setor de produ\ufffd\ufffdo, tamb\ufffdm digitava, j\ufffd que supervisionava a outros digitadores, estando em contato constante com o terminal do v\ufffddeo.A viola\ufffd\ufffdo do intervalo se traduz em  acr\ufffdscimo na remunera\ufffd\ufffdo, devendo considerar-se a omiss\ufffdo com tempo de trabalho em hora extra ilegal, que dever\ufffd refletir no pagamento de f\ufffdrias, gratifica\ufffd\ufffdo de f\ufffdrias, 13\ufffd sal\ufffdrio, FGTS, DSRs e aviso pr\ufffdvio.07.
