A partir do m\ufffds de &#8230;. de &#8230;., passou a exercer a fun\ufffd\ufffdo de &#8230;., junto \ufffd &#8230;., quando sua jornada de trabalho passou a ser de 11,30 hs di\ufffdrias de segunda \ufffds sextas-feiras, com intervalos de 1,30 hs (uma hora e meia) para suas refei\ufffd\ufffdes e descanso, ou seja, de 10,00 (dez) horas efetivamente trabalhadas, entrando \ufffds 7,30 hs e saindo \ufffds 12,30 hs para almo\ufffdo, retornando \ufffds 14,00 hs e saindo \ufffds 19,00 hs, de segundas \ufffds sextas-feiras, passando a prestar assim, um total de 4,00 (quatro) horas extras por dia.3. A partir de &#8230;. de &#8230;. de &#8230;., assumiu a Ger\ufffdncia Geral do Banco &#8230;., por exig\ufffdncia deste passou a Recte. a entrar em servi\ufffdo meia hora mais cedo, ou seja, \ufffds 7,00 hs para atender \ufffd determina\ufffd\ufffdo do mesmo de cuidar e controlar o caf\ufffd da manh\ufffd dos funcion\ufffdrios, passando assim a Recte. a fazer a jornada de 12,00 hs, entrando \ufffds 7,00 hs, saindo \ufffds 12,30 hs para almo\ufffdo, retornando \ufffds 14,00 hs e saindo \ufffds 19,00 hs, passando a prestar assim 4,30 hs (quatro horas e trinta minutos) de extras por dia de segundas \ufffds sextas-feiras, regime de hor\ufffdrio este que cumpriu desde &#8230;. de &#8230;. de &#8230;. at\ufffd &#8230;. de &#8230;. de &#8230;. quando foi INJUSTAMENTE AFASTADA DE SUAS FUN\ufffd\ufffdES, para ser INJUSTAMENTE DESPEDIDA EM &#8230;. de &#8230;. de &#8230;.4. Deste modo, prestou a Recte. ao Recdo., nos \ufffdltimos &#8230;. (&#8230;.) anos, o total de &#8230;. horas extraordin\ufffdrias, assim discriminadas:de &#8230;\/&#8230;\/&#8230; a &#8230;\/&#8230;\/&#8230;, &#8230;. dias de &#8230;. hs. por dia = &#8230;. hs Exde &#8230;\/&#8230;\/&#8230; a &#8230;\/&#8230;\/&#8230;, &#8230;. dias de &#8230;. hs. por dia = &#8230;. hs Exou sejam o total de  &#8230;. = &#8230;. hs Exsem que o Recdo. lhe pagasse qualquer quantia ou qualquer compensa\ufffd\ufffdo pelas excessivas Horas-Extras trabalhadas, o que dever\ufffd pag\ufffd-las com os acr\ufffdscimos e integra\ufffd\ufffdes legais como de direito.5. A  Recte. vinha percebendo ultimamente o sal\ufffdrio de R$ &#8230;., conforme faz prova o seu contra-cheque anexo doc. &#8230;., ou seja, o sal\ufffdrio de R$ &#8230;. por hora, donde resulta que a Hora-Extraordin\ufffdria acrescida de 50% (cinq\ufffdenta por cento) nos termos do inciso XVI , do art. 7 (s\ufffdtimo) da C. Federal \ufffd de R$ &#8230;.6. Assim, conforme c\ufffdlculo acima, tendo a Recte. prestado, nos \ufffdltimos dois anos, a soma de &#8230;. horas-extras j\ufffd descontados os dias de domingos, s\ufffdbados e feriados do per\ufffdodo, a R$ &#8230;. por hora, j\ufffd com acr\ufffdscimo de 50% (cinq\ufffdenta por cento), tem ela  a receber a t\ufffdtulo de horas-extras  a soma de R$ &#8230;.7. A Recte. vinha trabalhando normalmente no Banco Recdo sob a Ger\ufffdncia sadia e capaz do ent\ufffdo Gerente &#8230;., onde vinha desempenhando sua fun\ufffd\ufffdo com a mais absoluta dedica\ufffd\ufffdo e respeito, at\ufffd que em &#8230;. de &#8230;., assumiu a Ger\ufffdncia Adjunta o Sr. &#8230;. que, com poucos dias de Chefia Adjunta, j\ufffd come\ufffdou a pretender aproximar-se da Recte. de modo indesej\ufffdvel, a dirigir-lhe gracejos e insinua\ufffd\ufffdes, passando da\ufffd para o ASS\ufffdDIO E AO ASS\ufffdDIO SEXUAL, COM CONVITES INDECOROSOS TAIS COMO:  &quot;SAIR \ufffd NOITE&quot;, &quot;PASSA A NOITE EM MOTEL&quot;, ETC.; ASS\ufffdDIO ESTE QUE CHEGOU AO C\ufffdMULO INSUPORT\ufffdVEL DE VERDADEIRA PERSEGUI\ufffd\ufffdO, N\ufffdO S\ufffd DENTRO DO BANCO, DURANTE A JORNADA DE TRABALHO DA RECTE., COMO TAMB\ufffdM FORA DELE ONDE REFERIDO GERENTE DESCOBRIA QUE A RECTE. IRIA PASSAR.8. O ass\ufffddio deste Gerente sob a Recte. foi acontecendo sempre num crescendo, a ponto de o mesmo chegar a determinar servi\ufffdos e viagens para a Recte. em outras cidades vizinhas, para, com desculpas esfarrapadas acompanh\ufffd-la, certo de que a Recte. n\ufffdo podia recusar a ordem, como de fato n\ufffdo as recusava. Mas, para cumprir tais tarefas, a Recte. se fez acompanhar de seu filho de 16 anos de idade, porque tinha a certeza de que o Gerente iria acompanh\ufffd-la, como de fato, todas as vezes aconteceram.9. A Recte. por R. senten\ufffdas do MM. Juiz de Direito da &#8230;. Vara de Comarca de &#8230;., neste Estado, na ocasi\ufffdo, se achava Separada Legalmente do seu marido, mas, a partir de &#8230;. de &#8230;., havendo reconcilia\ufffd\ufffdo com seu marido, com este passou a viver vida conjugal, normal, fato de que referido Gerente tinha conhecimento, mas mesmo assim, n\ufffdo dava sossego \ufffd Recte. e sempre assediando-a, tudo fazia para impedir a reconcilia\ufffd\ufffdo da Recte. com seu marido, fazendo propostas das mais absurdas, no que foi sempre repelido.10.  Assim, sempre repelido nas suas investidas e ass\ufffddios, referido Gerente, vendo que nada conseguia com a Recte., mudou sua pol\ufffdtica, passou dos galanteios, a ass\ufffddios e convites indecorosos, para as persegui\ufffd\ufffdes cada vez mais acirradas, criando toda esp\ufffdcie de dificuldade para a Recte. em todos os sentidos, de suas fun\ufffd\ufffdes, esperando que a Recte. cedesse em sua resist\ufffdncia aos seus desonestos, criminosos e bestiais intentos (criar dificuldades, para conceder facilidades) e o pre\ufffdo desta facilidade era a Recte. entregar-se.11. Com efeito, para for\ufffdar a Recte. a entregar-se, o dito Gerente come\ufffdou atribuindo-lhe de modo incorreto e injusto a responsabilidade de uma d\ufffdvida do seu marido, em outra ag\ufffdncia do mesmo Banco, da qual a Recte. n\ufffdo era co-devedora, avalista, fiadora ou sob qualquer forma co-respons\ufffdvel, e o fez sob press\ufffdo, mediante comunica\ufffd\ufffdo do Banco para denegrir o bom nome e a boa fama da Recte. junto ao seu empregador, onde esta s\ufffd teve ascend\ufffdncia, merc\ufffd de seus m\ufffdritos, for\ufffdando, inclusive, a Recte. a se obrigar por escrito como respons\ufffdvel de uma d\ufffdvida de seu marido em outra Ag\ufffdncia do Banco &#8230;., para depois coagi-la \ufffd sua liquida\ufffd\ufffdo sob a amea\ufffda de denunci\ufffd-la \ufffd Diretoria e de apont\ufffd-la como funcion\ufffdria inadimplente.12. E mais, a fim de alcan\ufffdar seu maquiav\ufffdlico intento, referido Gerente chegou a negar o pagamento devido das f\ufffdrias vencidas da Recte., para a data por esta pedida, que era justamente para liquidar aquela obriga\ufffd\ufffdo, que ele, Gerente, a fez assumir, e com isso impedir que a Recte. resgatasse aquele compromisso, para poder apont\ufffd-la como inadimplente perante \ufffd Diretoria do Banco como o fez. 13. Diante de tanta persegui\ufffd\ufffdo e baixezas, a Recte. reclamou ao referido Gerente, fazendo-o ver que suas atitudes n\ufffdo tinham sentido e n\ufffdo eram justas, tendo dito Gerente respondido: &quot;tudo depende de voc\ufffd&quot; &#8211; &quot;voc\ufffd podia estar numa boa&quot; &#8211; &quot;se tornasse as coisa mais f\ufffdceis&quot; &#8211; &quot;voc\ufffd quer ser durona ?&quot; &#8211; &quot;vamos ver at\ufffd onde voc\ufffd ag\ufffdenta&quot; &#8211; &quot;deixe esse orgulho de lado e vamos resolver tudo com amor&quot; &#8211; &quot;sejamos bons amantes e ver\ufffds que tudo ficar\ufffd mais f\ufffdcil&quot;. 14. Assim, acuada, perseguida, coagida, assediada e desrespeitada com tal impune crueldade, a Recte. n\ufffdo teve outra escolha, a n\ufffdo ser procurar o seu  Regional e a Pol\ufffdcia e a estes fazer as sua queixas conforme narrado no Boletim de Ocorr\ufffdncia Policial lavrado na Delegacia de Pol\ufffdcia da Defesa da Mulher de &#8230;. sob n\ufffd &#8230;., assim relatando: &quot;Que, desde 1988, quando o referido Gerente assumiu a Ger\ufffdncia Adjunta daquela Ag\ufffdncia, o mesmo passou a assediar a queixosa e como sempre foi repelido em suas investidas e ass\ufffddios, passou a perseguir e a fazer amea\ufffdas de prejudicar a Recte., n\ufffdo s\ufffd no \ufffdmbito do trabalho, como tamb\ufffdm, quanto ao seu cheque especial, fazendo inclusive insinua\ufffd\ufffdes, quando \ufffd integridade moral da Recte. dizendo que se a mesma cedesse aos seus desejos, todos os seus problemas seriam resolvidos, e como a Recte. n\ufffdo cedeu, o tal, Gerente, come\ufffdou a fazer &quot;terrorismo&quot; com a Recte., chegando a tranc\ufffd-la certo dia na cozinha do Banco, dizendo-lhe que tinha que pagar a d\ufffdvida do seu marido para o Banco, dizendo tamb\ufffdm que a situa\ufffd\ufffdo poderia ser diferente, pois seu marido nada podia lhe  cobrar, j\ufffd que foram separados e que ela poderia sair com quem quisesse, chegou ao c\ufffdmulo de fazer perguntas, &quot;se a Recte. conseguia manter rela\ufffd\ufffdes sexuais normalmente em dias exaustivos: e dizendo a Recte. esta se atrasava na volta de outra Ag\ufffdncia onde ia prestar algum servi\ufffdo, que a Recte. &quot;certamente a Recte. deveria ter passado em algum Motel&quot;, e que ele Gerente gostaria de ter sido o felizardo&quot;, se a Recte. gostaria de ir com ele, Gerente, a um Motel ?&quot;, fazendo assim a vida da Recte., em seu local de trabalho, um verdadeiro inferno, pois, al\ufffdm de persegu\ufffd-la em todos os sentidos,<\/p>\n<p> dando cantadas e fazendo propostas, tamb\ufffdm lhe fazia chantagem.15. A partir de mar\ufffdo de 1994, mesmo como Gerente Geral da Ag\ufffdncia, continuou dando &quot;cantadas&quot; e assediando a Recte. e quando tomou conhecimento de que a Recte. havia pedido prote\ufffd\ufffdo ao Gerente Regional  em Assis e apresentado Queixa \ufffd Pol\ufffdcia (Boletim de Ocorr\ufffdncia anexo, doc. &#8230;. e &#8230;.), referido Gerente procurou inverter os pap\ufffdis e inventar e construir falsas faltas, contra a Recte. para se cobrir e conseguir afastamento do Banco, para o que, passou a se utilizar de suas  condi\ufffd\ufffdes e for\ufffda de Gerente Geral, para as quais contou com a conveni\ufffdncia de seus asseclas e colegas de sua c\ufffdpula e do seu n\ufffdvel, e com isso, conseguiu, fazer com que fosse instaurado um Processo de Sindic\ufffdncia contra a Recte. sob den\ufffdncia de falsas faltas que jamais foram apuradas, mas que, para evitar o Esc\ufffdndalo na Corte&quot; e acomodar os interesses subalternos do referido Gerente e de seus asseclas, de c\ufffdpula, onde todos dependem uns dos outros e todos entre si, a solu\ufffd\ufffdo dada foi : 1. Aposentar o referido Gerente, como aconteceu e 2. Demitir a Recte. por Justa Causa, sem sequer lhe dar a conhecer qual a falta ensejada dessa suposta Justa Causa ,pois a Recte. foi demitida t\ufffdo somente pela esp\ufffdria  comunica\ufffd\ufffdo atrav\ufffds de Carta anexa, datada de &#8230;\/&#8230;\/&#8230;, doc. &#8230;., nos termos seguintes:&#8230;., &#8230;. de &#8230;. de &#8230;. &quot;A Sra.  &#8230;.FUNCIONALISMO &#8211; Decidimos rescindir o seu contrato de trabalho por justa causa, com base no artigo 482 da CLT, devendo o seu desligamento dar-se nesta mesma data.Outrossim, fica V. Sra. cientificado de que deve comparecer ao Banco para acerto de contas e homologa\ufffd\ufffdo da rescis\ufffdo do contrato de trabalho, dentro do prazo de 10 dias a contar de seu desligamento, impreterivelmente.Banco do Estado de S\ufffdo Paulo S.A.&quot; (negrito nosso)16. Acontece E. Junta que comparecendo na data marcada para Homologa\ufffd\ufffdo da Rescis\ufffdo de seu Contrato de Trabalho, tal n\ufffdo aconteceu, porque a \ufffdnica proposta do Recdo. foi a Recte. concordar com a suposta Justa Causa do seu despedimento, o que \ufffd um arrematado e desonesto absurdo, pelo que, referida Rescis\ufffdo do seu Contrato laboral n\ufffdo foi homologada. Termo anexo, doc. &#8230;., e nem tem qualquer cabimento, pois trata-se de prestados ao Recdo.17. Note-se E. Junta que, em sua insaci\ufffdvel e doentia persegui\ufffd\ufffdo \ufffd Recte., referido Gerente chegou ao ponto de ir atr\ufffds  de um advogado, Dr. Levi Raimundo, para pedir a sua afirma\ufffd\ufffdo sobre eventual empr\ufffdstimo por ele, eventualmente feito \ufffd Recte. e, em caso positivo, se a Recte. lhe teria dado algum preju\ufffdzo e chegou a pedir informa\ufffd\ufffdes sobre a Recte. no servi\ufffdo de Prote\ufffd\ufffdo de Cr\ufffddito conforme se v\ufffd da informa\ufffd\ufffdo anexa,doc. &#8230;. Enfim, foram tantos os ass\ufffddios, persegui\ufffd\ufffdes e buscas com fito de prejudicar a Recte. que referido Gerente praticou que, estando a Recte. gr\ufffdvida, de tanto sofrer os impactos da abalos nervosos e emocionais negativos, a mesma caiu em depress\ufffdo a acabou sofrendo aborto, perdendo o seu nen\ufffd, conforme fazem prova os atestados anexos, doc. &#8230;. e &#8230;., tudo por culpa do referido Gerente-Representante Legal do Banco Reclamado que, casado, pai de fam\ufffdlia, n\ufffdo soube respeitar sua mulher e filhos e muito menos o elevado cargo que ocupava no  Banco Recdo.18. Assim, foi a Recte.
