Posteriormente passou a MONITOR DE MERCHANDISING e a partir de &#8230;\/&#8230;\/&#8230; exerceu as fun\ufffd\ufffdes de SUPERVISOR, at\ufffd a despedida.A demiss\ufffdo sob a alega\ufffd\ufffdo de justa causa, que diga-se desde j\ufffd, inexistente, deu-se em &#8230;\/&#8230;\/&#8230;, sendo as verbas pagas com base na sua maior remunera\ufffd\ufffdo de R$ &#8230;.Os sal\ufffdrios evolu\ufffdram conforme os demonstrativos anexos. O conjunto remunerat\ufffdrio era composto de ordenado, plano est\ufffdmulo, pr\ufffdmio e adicional de tempo de servi\ufffdo.Durante o v\ufffdnculo teve seus direitos lesados como adiante se ver\ufffd:1. DA INEXIST\ufffdNCIA DE JUSTA CAUSAO reclamante foi demitido segundo a reclamada, por justa causa, que data venia n\ufffdo existiu, por impresentes no caso, quaisquer dos atos faltosos elencados no art. 482 do Estatuto Consolidado que possibilita a despedida motivada.Em total desrespeito aos mais elementares princ\ufffdpios de direito, a reclamada imputou ao reclamante a pecha da improbidade, sem que em momento algum seus atos dessem motiva\ufffd\ufffdo para esta.Curvando-se aos mais de quatorze anos de servi\ufffdos prestados , deveria a reclamada bem fundamentar os alegados atos, que segundo esta deixou transparecer, teriam sido praticados pelo reclamante em contr\ufffdrio aos padr\ufffdes morais.Diga-se que al\ufffdm de tudo, a justificar a ruptura do contrato em tela pela motiva\ufffd\ufffdo alegada, mister, al\ufffdm da prova cabal, a atualidade da falta imputada.Assim, inexistindo motiva\ufffd\ufffdo, h\ufffd que se ter a rescis\ufffdo como sem justa causa, condenando-se a reclamada ao pagamento do aviso pr\ufffdvio, 13\ufffd sal\ufffdrio, f\ufffdrias e multa do FGTS incidente sobre os dep\ufffdsitos havidos bem como libera\ufffd\ufffdo dos mesmos pelo c\ufffdd. 01 e entrega das guias respectivas.2. 1\/12 DE F\ufffdRIAS E 13\ufffd SAL\ufffdRIOO aviso pr\ufffdvio mesmo indenizado, projeta o tempo de servi\ufffdo do reclamante para o m\ufffds &#8230;.\/&#8230;. e diante disso faz jus em receber mais 1\/12 de f\ufffdrias e 13\ufffd sal\ufffdrio.3. VERBAS RESCIS\ufffdRIAS PARA SAL\ufffdRIO REAJUSTADOCom dito, o aviso pr\ufffdvio mesmo indenizado, para todos os efeitos projeta o tempo de servi\ufffdo do reclamante para o m\ufffds &#8230;.\/&#8230;. e neste, face pertencer ao Grupo A com data base em maio, o sal\ufffdrio deveria ser reajustado para R$ &#8230;., e bem assim os demais itens que comp\ufffde o seu conjunto remunerat\ufffdrio.Com efeito, a portaria interministerial MTb\/MF\/SEPLAN 20\/93 publicado em 31.12.93 assim estabelece:Os sal\ufffdrios dos trabalhadores do Grupo A, cujas datas-base ocorreram nos meses de janeiro, maio, e setembro, referente ao m\ufffds de janeiro de 1994 ser\ufffdo calculados.I &#8211; Multiplicando-se os sal\ufffdrios vigentes em 01.09.93 pelo fator 3.422.966 para os sal\ufffdrios at\ufffd CR$ 197.292,00 naquele m\ufffds.Assim, al\ufffdm do reajuste no ordenado, mister reajustar tamb\ufffdm e nas mesmas propor\ufffd\ufffdes, os respectivos valores pagos a t\ufffdtulo de plano est\ufffdmulo e adicional por tempo de servi\ufffdo, porque a parcela integrante da remunera\ufffd\ufffdo e habitual, (CCT 93\/94 cl\ufffdusula 05).Devidos pois, o aviso pr\ufffdvio, 13\ufffd sal\ufffdrio e f\ufffdrias, inclusive pela proje\ufffd\ufffdo do primeiro, com base no sal\ufffdrio j\ufffd reajustado na forma retro.Devido tamb\ufffdm a diferen\ufffda do adicional de tempo de servi\ufffdo e plano est\ufffdmulo, decorrentes do reajuste em tela.4. SEGURO DESEMPREGOA n\ufffdo entrega das respectivas guias do seguro desemprego foi motivada pelo ato unilateral da reclamada. Uma vez descaracterizada a justa causa, devido ao reclamante tais guias e em sendo isto imposs\ufffdvel, o correspondente pagamento de 4 (quatro) parcelas pelo valor do conjunto remunerat\ufffdrio devido inclusive face os pleitos da presente.Consigne-se que se encontram preenchidos os requisitos para tal.5. URP DE FEVEREIRO\/89 &#8211; 26,05%A determina\ufffd\ufffdo das Unidades de Refer\ufffdncia de Pre\ufffdos &#8211; URP era obtida atrav\ufffds da m\ufffddia da varia\ufffd\ufffdo do IPC ocorrida no trimestre imediatamente anterior e deveria corrigir os sal\ufffdrios em cada um dos tr\ufffds meses subsequentes.Assim, por exemplo, a varia\ufffd\ufffdo ocorrida nos meses de mar\ufffdo, abril e maio de 1988 &#8211; 17,68% deveria corrigir os sal\ufffdrios dos meses 06, 07 e 08\/88. O mesmo ocorreu em cada trimestre de junho de 1987 a janeiro de 1989 quando foi revogada aquela pol\ufffdtica salarial, pela MP n\ufffd 32.A citada MP n\ufffd &#8211; Plano Ver\ufffdo, extinguiu as URP\ufffds a partir de 15.01.89. No entanto, em face do DL 2.335\/87, que at\ufffd ent\ufffdo vigia, estava incorporado ao patrim\ufffdnio jur\ufffddico do reclamante o direito a ter seu sal\ufffdrio reajustado em 26,05%, tamb\ufffdm em fevereiro\/89.Cristalino o instituto do direito adquirido, que necessitava apenas do decurso temporal para ser exercido, pelo que \ufffd devido o reajuste de 26,05% em fevereiro\/89, com repercuss\ufffdo nos meses subsequentes, que refletir\ufffdo em f\ufffdrias, 13\ufffd sal\ufffdrio e rescis\ufffdrias.6. IPC DE 84,32% EM ABRIL\/90Em abril de 1990 o sal\ufffdrio do reclamante deveria ter sido reajustado em 84,32% face o disposto na Lei n\ufffd 77.88\/89.Referido diploma legal, vigente at\ufffd 15.03.90 determinava que os sal\ufffdrios deveriam ser reajustados com base no IPC ocorrido no m\ufffds imediatamente anterior.Tal pol\ufffdtica salarial foi revogada pela edi\ufffd\ufffdo do Plano de Estabiliza\ufffd\ufffdo Nacional &#8211; Plano Collor, atrav\ufffds da Medida Provis\ufffdria n\ufffd 154, em 16.03.90.No momento da revoga\ufffd\ufffdo (16.03), j\ufffd se havia incorporado ao patrim\ufffdnio jur\ufffddico do Reclamante, o direito ao reajuste salarial pelo \ufffdndice do IPC de mar\ufffdo, em abril do mesmo ano de 1990.Aludido direito decorre do fato do IPC ser calculado entre o dia 16 de um m\ufffds e o dia 15 do m\ufffds seguinte. No dia 16 de mar\ufffdo j\ufffd se sabia que a varia\ufffd\ufffdo do IPC entre 16.02.90 e 15.03.90 foi de 84,32%. Esse estado inflacion\ufffdrio era uma realidade palp\ufffdvel, sendo flagrante ent\ufffdo o preju\ufffdzo salarial.O direito ao reajuste restou adquirido, dependendo t\ufffdo s\ufffd do decurso temporal para ser exercido. E nem se alegue que a quebra da espiral inflacion\ufffdria justificaria a supress\ufffdo deste questionado reajuste, pois o mesmo objetivava apenas recompor o sal\ufffdrio pela deteriora\ufffd\ufffdo inflacion\ufffdria ocorrida at\ufffd 15.03.90, anterior portanto ao plano de estabiliza\ufffd\ufffdo econ\ufffdmica.Assim faz jus tamb\ufffdm ao sal\ufffdrio de abril\/90, reajustado pelo IPC de 84,32% ocorrido no m\ufffds anterior, com repercuss\ufffdo nos meses subsequentes at\ufffd a rescis\ufffdo, com reflexos nas verbas pagas nesta em f\ufffdrias e 13\ufffd sal\ufffdrio.7. ADICIONAL DE TRANSFER\ufffdNCIASempre com mudan\ufffda de domic\ufffdlio, e por necessidade do servi\ufffdo a reclamada por diversas ocasi\ufffdes transferiu o reclamante para localidade diversas, a saber:Admitido para trabalhar na cidade de &#8230;., em &#8230;.\/&#8230;. foi transferido para &#8230;.Em &#8230;.\/&#8230;. foi transferido para &#8230;.Em &#8230;.\/&#8230;. foi transferido para &#8230;.Em &#8230;.\/&#8230;. foi transferido para &#8230;.E finalmente em &#8230;.\/&#8230;. foi transferido desta \ufffdltima para &#8230;., onde permaneceu at\ufffd a demiss\ufffdo.Em nenhuma destas transfer\ufffdncias lhe foi pago o respectivo adicional, devido no percentual de 25% em todo o per\ufffdodo por for\ufffda do disposto no art. 469 par\ufffdgrafo 3\ufffd do Estatuto Consolidado, a qual integra o sal\ufffdrio para efeito de f\ufffdrias, 13\ufffd sal\ufffdrio, aviso pr\ufffdvio, horas extras, adicional por tempo de servi\ufffdo, plano est\ufffdmulo e pr\ufffdmio.8. HORAS EXTRASTrabalhava o reclamante no hor\ufffdrio das 8:00 \ufffds 20:00 horas com intervalo de 15\/30 minutos de segunda \ufffd sexta-feira sendo que aos s\ufffdbados, uma vez por m\ufffds, juntamente com sua equipe de venda, participava de reuni\ufffdes pela manh\ufffd ou a tarde por 4\/5 horas. Uma vez por m\ufffds tamb\ufffdm aos domingos realizava viagens com in\ufffdcio \ufffds 8:00 at\ufffd as 20\/21 horas.A subordina\ufffd\ufffdo a hor\ufffdrio \ufffd patente na medida em que deveria chegar \ufffds 8:00 horas no primeiro cliente nominado\/relacionado num roteiro de viagem\/visitas, seguido a risca, somente modificado por determina\ufffd\ufffdo da pr\ufffdpria chefia.A reclamada face os roteiros mencionados, localizava o reclamante naquele cliente em determinado hor\ufffdrio.Os hot\ufffdis eram previamente determinados, devendo-se ressaltar que toda segunda-feira o comparecimento na filial era obrigat\ufffdrio, para participa\ufffd\ufffdo em reuni\ufffdes.Assim, em todo o per\ufffdodo devidas como extras as horas excedentes da oitava di\ufffdria de segunda a sexta e da quarta aos s\ufffdbados com adicional de 50%, bem como domingos em dobro, as quais refletem em RSR e juntos em f\ufffdrias 13\ufffd sal\ufffdrio e aviso pr\ufffdvio.9. DEVOLU\ufffd\ufffdO DE R$ &#8230;. EM &#8230;\/&#8230;\/&#8230;Em decorr\ufffdncia de acidente envolvendo ve\ufffdculo com ao qual trabalhava o reclamante, n\ufffdo por culpa sua, diga-se, a reclamada o fez desembolsar o correspondente valor da franquia, como comprova o documento incluso.Tal pr\ufffdtica o foi em desacordo ao Estatuto Consolidado cujo<\/p>\n<p> art. 462 veda qualquer dedu\ufffd\ufffdo.Ademais, em momento algum agiu o reclamante com dolo ou culpa pelo que o valor em tela h\ufffd que ser devolvido em dobro.10. PR\ufffdMIOAnualmente a reclamada realizava concurso, premiando os funcion\ufffdrios\/equipes com destaque nas vendas.Em 93, a equipe do Reclamante fechou vendas, atingindo a meta estipulada que deu o direito aos integrantes a uma viagem a &#8230;., com todas as despesas pagas, inclusive, hotel.Mesmo antes da despedida do reclamante, tal meta j\ufffd havia sido atingida e mesmo que n\ufffdo fosse, descaracterizada a justa causa, devido o aviso pr\ufffdvio, que como visto, para todos os efeitos legais projeta o tempo de servi\ufffdo para 01\/&#8230;, possibilitando ao reclamante a referida viagem.Com o ato unilateral da reclamada, o reclamante se viu privado de tal desfrute sendo-lhe ent\ufffdo devido, no m\ufffdnimo, o valor correspondente desta estada, apurado em execu\ufffd\ufffdo de senten\ufffda.11. DESCONTOS\/DEVOLU\ufffd\ufffdOInfere-se dos demonstrativos de pagamentos (anexo) que mensalmente e em todo per\ufffdodo a reclamada efetuava v\ufffdrios descontos do reclamante a t\ufffdtulo de Seguro Autom\ufffdvel, Gr\ufffdmio Mensalidade, Seguro de Vida em Grupo, Coop. Cred. Capital, donativos, Plano de Sa\ufffdde, pelos valores l\ufffd consignados.Tal procedimento \ufffd ilegal a teor do contido no art. 462 do Estatuto Consolidado, pelo que os valores dever\ufffdo a final ser devolvidos e em dobro, devidamente atualizados.\ufffd jurisprud\ufffdncia assente que:SAL\ufffdRIO &#8211; SEGURO DE VIDA &#8211; DESCONTO &#8211; PRESSUPOSTO. A lei ordin\ufffdria &#8211; art. 462 da CLT &#8211; \ufffd clara a respeito: s\ufffd pode haver desconto no sal\ufffdrio a t\ufffdtulo de seguro de vida se previsto em lei ou contrato coletivo &#8211; acordo ou conven\ufffd\ufffdo. O objetivo da norma legal \ufffd preservar o princ\ufffdpio constitucional da irredutibilidade salarial &#8211; art. 7\ufffd, VI, d a CF (TST &#8211; Ac. 1.937 da 3\ufffd T. publ. em 13.08.93 &#8211; RR 53.080\/92.8 Rel. Min. Manoel Mendes de Freitas: in ADCO &#8211; AS 142.590).FACE O EXPOSTO RECLAMA:a) Declara\ufffd\ufffdo de inexist\ufffdncia da justa causa;b) Aviso pr\ufffdvio de 30 dias com base no sal\ufffdrio para &#8230;.\/&#8230;. (R$ &#8230;.);c) 13\ufffd sal\ufffdrio\/&#8230;. (12\/12) + 1\/12 avos pela proje\ufffd\ufffdo do Aviso Pr\ufffdvio com base no sal\ufffdrio j\ufffd reajustado;d) f\ufffdrias proporcionais (7\/12) + 1\/3 + 1\/12 avos pela proje\ufffd\ufffdo do aviso pr\ufffdvio com base no sal\ufffdrio j\ufffd reajustado;e) Libera\ufffd\ufffdo do FGTS depositado e pagamento da respectiva multa de 40%;f) Diferen\ufffdas de plano est\ufffdmulo e adicional por tempo de servi\ufffdo face o reajuste em &#8230;.\/&#8230;., conforme discrimina\ufffd\ufffdo da presente;g) Parcelas do Seguro Desemprego, em n\ufffdmero de 4 (quatro), correspondente ao maior sal\ufffdrio recebido ou devido conforme discrimina\ufffd\ufffdo da presente, integrado das horas extras e RSR;h) Em todo o per\ufffdodo, horas extras excedentes da oitava di\ufffdria de segunda a sexta-feira e da quarta aos s\ufffdbados, com adicional de 50% e domingos trabalhados em dobro, calculadas com base no conjunto remunerat\ufffdrio percebido, bem como decorrentes dos pleitos da presente, devendo refletirem em f\ufffdrias + 1\/3 adicional, 13\ufffd sal\ufffdrio, DSR e aviso pr\ufffdvio, observando o divisor 220 ante a carga semanal de 44 horas;i) Diferen\ufffdas salariais pela incid\ufffdncia da URP de 26,05% em 02\/89 e IPC de 84,32% em 04\/90, com repercuss\ufffdo nos meses subsequentes at\ufffd a rescis\ufffdo, devendo refletirem nas verbas pagas nesta, em 13\ufffd sal\ufffdrio, f\ufffdrias + 1\/3 de adicional em todo o per\ufffdodo e no aviso pr\ufffdvio;j) Adicional de transfer\ufffdncia no percentual de 25% sobre o sal\ufffdrio percebido, entendido como tal o conjunto remunerat\ufffdrio, durante todo o per\ufffdodo, por for\ufffda do disposto no art. 469, par\ufffdgrafo 3\ufffd da CLT, observados os pleitos da presente, devendo refletir em RSR e juntos em f\ufffdrias, 13\ufffd sal\ufffdrio e aviso pr\ufffdvio;l) Devolu\ufffd\ufffdo do valor de CR$ &#8230;. desembolsado em &#8230;\/&#8230;\/&#8230;, em dobro;m) FGTS mais <\/p>\n","protected":false},"featured_media":0,"parent":0,"menu_order":0,"template":"","meta":{"content-type":""},"categoria-modelo":[497],"class_list":["post-3013761","modelos-de-peticao","type-modelos-de-peticao","status-publish","hentry","categoria-modelo--novo-cpc"],"_links":{"self":[{"href":"https:\/\/easyjur.com\/blog\/wp-json\/wp\/v2\/modelos-de-peticao\/3013761","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/easyjur.com\/blog\/wp-json\/wp\/v2\/modelos-de-peticao"}],"about":[{"href":"https:\/\/easyjur.com\/blog\/wp-json\/wp\/v2\/types\/modelos-de-peticao"}],"wp:attachment":[{"href":"https:\/\/easyjur.com\/blog\/wp-json\/wp\/v2\/media?parent=3013761"}],"wp:term":[{"taxonomy":"categoria-modelo","embeddable":true,"href":"https:\/\/easyjur.com\/blog\/wp-json\/wp\/v2\/categoria-modelo?post=3013761"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
