(endere\u00e7o completo: rua [av.], no, complemento, bairro, cidade, CEP, UF), inscrita no CNPJ\/MF sob no &#8230;&#8230;&#8230;&#8230;&#8230;., por seu advogado e procurador abaixo assinado (doc. &#8230;..), vem respeitosamente perante Vossa Excel\u00eancia propor a presente <\/p>\n<h1><strong> <\/strong><\/h1>\n<h1><strong>A\u00c7\u00c3O DE DESPEJO CUMULADA COM A\u00c7\u00c3O DE COBRAN\u00c7A <\/strong><\/h1>\n<\/p>\n<p>em face de &#8230;&#8230;&#8230;&#8230;&#8230;&#8230; (raz\u00e3o social completa), empresa estabelecida \u00e0 &#8230;&#8230;&#8230;&#8230;&#8230; (endere\u00e7o completo: rua [av.], no, complemento, bairro, cidade, CEP, UF), inscrita no CNPJ\/MF sob no &#8230;&#8230;&#8230;&#8230;, com fundamento nos artigos 9o, II e III, 62 e 63, \u00a7 1o, <em>b<\/em>, da Lei no 8.245\/1991, pelos motivos de fato e de direito que passa a expor. <\/p>\n<\/p>\n<p>I. <\/p>\n<p>As partes firmaram, por escrito, contrato de loca\u00e7\u00e3o do im\u00f3vel situado \u00e0 &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. (endere\u00e7o completo: rua [av.], no, complemento, bairro, cidade, CEP, UF), de propriedade da Autora, pelo prazo de &#8230;&#8230;&#8230;.. (por extenso) meses, pelo valor de R$ &#8230;&#8230;&#8230;. (valor por extenso) (doc. &#8230;..), garantido pelo dep\u00f3sito de &#8230;.. (por extenso) meses de aluguel. <\/p>\n<\/p>\n<p>Ao t\u00e9rmino do prazo foi firmado adendo de prorroga\u00e7\u00e3o do contrato de loca\u00e7\u00e3o por mais &#8230;&#8230;.. (por extenso) meses, para viger at\u00e9 &#8230;&#8230;&#8230; (dia, m\u00eas e ano) (doc. &#8230;.). <\/p>\n<\/p>\n<p>Decorrido o prazo de &#8230;&#8230;&#8230;&#8230;. (per\u00edodo determinado para o reajuste) da loca\u00e7\u00e3o o aluguel foi reajustado pelo IGPM (ou outro \u00edndice acordado) para o valor de R$ &#8230;&#8230;&#8230;&#8230;&#8230;. (valor por extenso) (doc. &#8230;). <\/p>\n<\/p>\n<p>II. <\/p>\n<p>Ocorre que, desde o m\u00eas de refer\u00eancia de &#8230;&#8230;.. deste ano, a R\u00e9 n\u00e3o efetua os pagamentos dos alugu\u00e9is, parcelas do IPTU e demais encargos da loca\u00e7\u00e3o. <\/p>\n<\/p>\n<p>III. <\/p>\n<p>Por todas as infra\u00e7\u00f5es contratuais a R\u00e9 deve ser compelida ao pagamento da multa contratual prevista na cl\u00e1usula &#8230;&#8230;&#8230;. do contrato firmado entre as partes (doc. &#8230;.). <\/p>\n<\/p>\n<p>Diante do exposto, \u00e9 a presente para pleitear se digne Vossa Excel\u00eancia determinar a cita\u00e7\u00e3o da R\u00e9 para, querendo, emendar a mora ou contestar a presente a\u00e7\u00e3o no prazo legal, sob pena de revelia, sendo, a final, julgados totalmente procedentes os pedidos, rescindida a loca\u00e7\u00e3o e assinado o prazo de &#8230;&#8230;.. (por extenso) dias para desocupa\u00e7\u00e3o (art. 63, \u00a7 1o , <em>b<\/em>, da Lei no 8.245\/1991), com efetua\u00e7\u00e3o do despejo do im\u00f3vel se tal prazo n\u00e3o for cumprido, condenando-se a R\u00e9 ao pagamento de: <\/p>\n<\/p>\n<ol>\n<li>&#8211; alugu\u00e9is vencidos e vincendos, acrescidos da multa morat\u00f3ria, at\u00e9 o efetivo despejo e demais encargos da loca\u00e7\u00e3o, tais como contas de \u00e1gua, esgoto, g\u00e1s, luz, IPTU e outros, tudo acrescido de juros e corre\u00e7\u00e3o monet\u00e1ria at\u00e9 o efetivo pagamento, custas processuais, despesas e honor\u00e1rios advocat\u00edcios de &#8230;% (por extenso) conforme cl\u00e1usula &#8230;.. do contrato de loca\u00e7\u00e3o. <\/li>\n<\/ol>\n<p>A Autora requer a produ\u00e7\u00e3o de todas as provas admitidas em direito, especialmente depoimento pessoal do representante legal da R\u00e9, depoimentos testemunhais, juntada de documentos, per\u00edcias, vistorias e tudo o mais que se fizer necess\u00e1rio. <\/p>\n<\/p>\n<p>Autor\/requerente aberto \u00e0 concilia\u00e7\u00e3o\/media\u00e7\u00e3o, conforme a nova sistem\u00e1tica da Lei 13.105 de 2015.<\/p>\n<p>D\u00e1-se \u00e0 presente o valor de R$ &#8230;&#8230;&#8230;..
