CONTRATO<\/strong><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 1\u00aa.<\/strong> O presente contrato tem como OBJETO a loca\u00e7\u00e3o de espa\u00e7o comercial situado \u00e0 Rua (xxx), n\u00ba (xxx), Bairro (xxx), Cep (xxx), no Estado (xxx), atrav\u00e9s <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<strong> <\/strong><\/p>\n<p><strong>DA DESCRI\u00c7\u00c3O DOS BENS<\/strong><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 2\u00aa.<\/strong> O im\u00f3vel objeto deste contrato ser\u00e1 entregue nas condi\u00e7\u00f5es descritas no auto de vistoria, ou seja, com instala\u00e7\u00f5es el\u00e9tricas e hidr\u00e1ulicas em perfeito funcionamento, com paredes pintadas, sendo que portas, port\u00f5es e acess\u00f3rios se encontram tamb\u00e9m em funcionamento correto, devendo a <strong>LOCAT\u00c1RIA<\/strong>, mant\u00ea-lo desta forma. <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 3\u00aa.<\/strong> Os equipamentos e ferramentas objetos da loca\u00e7\u00e3o encontram-se especificados e com os respectivos valores individuais no rol de maquin\u00e1rios, que faz parte integrante do presente instrumento.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<strong> <\/strong><\/p>\n<p><strong>DAS BENFEITORIAS E CONSTRU\u00c7\u00d5ES<\/strong><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 8\u00aa.<\/strong> Qualquer benfeitoria ou constru\u00e7\u00e3o que seja destinada ao im\u00f3vel objeto deste, dever\u00e1, de imediato, ser submetida \u00e0 autoriza\u00e7\u00e3o expressa do <strong>LOCADOR<\/strong>.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 5\u00aa.<\/strong> Vindo a ser feita benfeitoria, faculta ao <strong>LOCADOR<\/strong> aceit\u00e1-la ou n\u00e3o, restando \u00e0 <strong>LOCAT\u00c1RIA<\/strong>, em caso do <strong>LOCADOR<\/strong> n\u00e3o aceit\u00e1-la, modificar o im\u00f3vel para que fique da maneira como lhe foi entregue. <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 6\u00aa.<\/strong> As benfeitorias, consertos ou reparos far\u00e3o parte integrante do im\u00f3vel, n\u00e3o assistindo \u00e0 <strong>LOCAT\u00c1RIA<\/strong> o direito de reten\u00e7\u00e3o ou indeniza\u00e7\u00e3o sobre a mesma.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/p>\n<p><strong>DA DURA\u00c7\u00c3O<\/strong><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 7\u00aa.<\/strong> O presente instrumento ter\u00e1 dura\u00e7\u00e3o de (xxx) Poder\u00e3o as partes efetuarem o t\u00e9rmino do contrato antes do prazo estabelecido, devendo a parte interessada efetuar a notifica\u00e7\u00e3o \u00e0 outra no prazo de (xxx) meses anteriores <\/strong><\/p>\n<p><strong>VALOR DO ALUGUEL, DESPESAS E TRIBUTOS<\/strong><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 8\u00aa.<\/strong> Como aluguel mensal, a <strong>LOCAT\u00c1RIA<\/strong> se obrigar\u00e1 a pagar o valor de R$ (xxx) (Valor expresso), a ser efetuado diretamente no endere\u00e7o residencial do <strong>LOCADOR<\/strong>, e na sua aus\u00eancia, ficar\u00e1 autorizado a receb\u00ea-lo seu procurador (xxx) (Nome do Procurador e endere\u00e7o completo), devendo faz\u00ea-lo at\u00e9 o quinto dia \u00fatil de cada m\u00eas subseq\u00fcente ao vencido, sob pena de multa de 10% sobre o valor da loca\u00e7\u00e3o, devidamente corrigido pelos \u00edndices di\u00e1rios da poupan\u00e7a.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 9\u00aa.<\/strong> Fica obrigado o <strong>LOCADOR<\/strong> ou seu procurador, a emitir recibo da quantia paga, relacionando pormenorizadamente todos os valores oriundos de juros, ou outra despesa. Emitir-se-\u00e1 tal recibo, desde que haja a apresenta\u00e7\u00e3o pela <strong>LOCAT\u00c1RIA<\/strong>, dos comprovantes de todas as despesas do im\u00f3vel devidamente quitadas. Caso a <strong>LOCAT\u00c1RIA<\/strong> venha a efetuar o pagamento do aluguel atrav\u00e9s de cheque, restar\u00e1 facultado ao <strong>LOCADOR<\/strong> emitir os recibos de pagamento somente ap\u00f3s compensa\u00e7\u00e3o do mesmo.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 10\u00aa.<\/strong> O valor do aluguel ser\u00e1 reajustado anualmente, tendo como base, os \u00edndices previstos e acumulados no per\u00edodo anual do (IGPM ou IGP ou IPC, etc.). Em caso de falta deste \u00edndice, o reajustamento do aluguel ter\u00e1 por base a m\u00e9dia da varia\u00e7\u00e3o dos \u00edndices inflacion\u00e1rios do ano corrente ao da execu\u00e7\u00e3o do aluguel, at\u00e9 o primeiro dia anterior ao pagamento de todos os valores devidos. Ocorrendo alguma mudan\u00e7a no \u00e2mbito governamental, todos os valores agregados ao aluguel, bem como o pr\u00f3prio aluguel, ser\u00e3o revistos pelas partes. Tal reajuste ocorrer\u00e1 independentemente de aviso ou interpela\u00e7\u00e3o judicial pr\u00e9via, e vigorar\u00e1 entre as partes e fiadores, no primeiro dia \u00fatil subseq\u00fcente a ocorr\u00eancia do mesmo.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 11\u00aa.<\/strong> A <strong>LOCAT\u00c1RIA<\/strong> se compromete ainda a efetuar em dia o pagamentos dos encargos tribut\u00e1rios que incidam ou venham a incidir sobre o im\u00f3vel, bem como todas aquelas ligadas direta ou indiretamente com a conserva\u00e7\u00e3o do im\u00f3vel, tais como \u00e1gua, luz, telefone, condom\u00ednio, etc.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<strong> <\/strong><\/p>\n<p><strong>DA RESTITUI\u00c7\u00c3O DOS BENS E EQUIPAMENTOS<\/strong><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 12\u00aa.<\/strong> Fica tamb\u00e9m acordado, que o im\u00f3vel ser\u00e1 devolvido nas mesmas condi\u00e7\u00f5es previstas no auto de vistoria, al\u00e9m de, no ato da entrega das chaves, com todos os tributos e despesas pagas, caso contr\u00e1rio, ficar\u00e1 facultado ao <strong>LOCADOR<\/strong> receb\u00ea-lo ou n\u00e3o.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 13\u00aa.<\/strong> Resta acordado que, no ato da entrega das chaves do im\u00f3vel, a <strong>LOCAT\u00c1RIA<\/strong> efetuar\u00e1 a restitui\u00e7\u00e3o de todos os equipamentos e ferramentas elencados no rol de maquin\u00e1rios, na quantidade que lhe foi entregue, sob pena de indeniza\u00e7\u00e3o dos valores unit\u00e1rios de cada uma.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Par\u00e1grafo \u00fanico.<\/strong> O <strong>LOCADOR<\/strong> ser\u00e1 tamb\u00e9m indenizado em rela\u00e7\u00e3o aos equipamentos e ferramentas que se encontrem danificados e imprest\u00e1veis para o fim a que se destinam, salvo aqueles com desgastes de uso comum.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<strong> <\/strong><\/p>\n<p><strong>CONDI\u00c7\u00d5ES GERAIS<\/strong><\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 18\u00aa.<\/strong> A <strong>LOCAT\u00c1RIA<\/strong> n\u00e3o poder\u00e1, sem expressa autoriza\u00e7\u00e3o do <strong>LOCADOR<\/strong>, em nenhuma hip\u00f3tese, sublocar os bens ou equipamentos a terceiros.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <strong>Cl\u00e1usula 15\u00aa.<\/strong> Exercer\u00e1 a <strong>LOCAT\u00c1RIA<\/strong> o direito de prefer\u00eancia na aquisi\u00e7\u00e3o do im\u00f3vel e dos demais equipamentos caso haja interesse do <strong>LOCADOR<\/strong> em efetuar a aliena\u00e7\u00e3o de tais bens.<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<br \/>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0
